NOTICE OF PUBLIC HEARING
In accordance with Chapter 119 of the Revised Code, the Public Health Council (Council) will conduct public hearings Thursday, March 9, 2006, beginning at 10:00 a.m. in the 8th floor conference room of the Ohio Department of Health, 246 North High Street, Columbus, Ohio. The hearings will concern the following actions:
· By authority of R.C. 3722.10, a proposal to amend rules 3701-20-01 to 3701-20-03, 3701-20-05, 3701-20-07 to 3701-20-15, 3701-20-17 to 3701-20-24 and 3701-20- 26 of the Ohio Administrative Code (O.A.C.). These rules, which pertain to licensing of adult care facilities (ACFs), are being filed pursuant to Revised Code (R.C.) 119.032, five-year rule review. The draft amendments: 1) add definitions; 2) clarify the Director of Health's options with respect to the imposition of civil money penalties; 3) state ACF management's responsibilities with respect to providing crisis handling and notification training to staff; 4) elaborate upon general staffing, personal care, Mantoux testing, and dietary services requirements; 5) elaborate upon an ACFs reporting obligations in the event of incidents that present a risk to a resident's health, safety, or well-being; and 6) set forth new space, equipment, safety, and sanitation requirements.
· By authority of R.C. 3718.02, to rescind rules 3701-29-01 to 3701-29-20 of the O.A.C., pertaining to household sewage disposal systems; and to adopt new rules 3701-29-01 to 3701-29-18, pertaining to sewage treatment systems. The proposed new rules: 1) place emphasis on soil and site evaluation, and the identification of risk factors related to soil limiting conditions, drainage, and hydrogeology that may impact water resources and public health; 2) provide technical tools and solutions to allow the placing of systems on challenging sites; 3) establish NPDES compliance and limitations on discharging systems; 4) set performance standards for watertight tanks, pretreatment component standards, effluent quality, and land application of septage; 5) address basic designs for soil absorption, mound, and drip distribution systems, and allow for alternative system designs; 6) set standards for the design and installation of small flow onsite sewage treatment systems; promotes proper operation and maintenance of systems and education of system owners in accordance with statute; 7) establish competency standards for installers, service providers, and septage haulers; and 8) create ODH authority for oversight of local health district sewage treatment system programs through a uniform survey process.
· By authority of R.C. 3701.221, to amend rule 3701-49-01.1 of the O.A.C. This rule pertains to fees for laboratory services. The proposed amendment will increase the current fee collected for newborn screening from $22.00 to $28.85. The proposed increase will cover the costs associated with adding cystic fibrosis and carnitine uptake disorder to the newborn screening panel.
· By authority of R.C. 4773.08, to amend rules 3701-72-01 to 3701-72-04 of the
O.A.C. These rules concern the licensing and education programs for general x-ray machine operators, radiographers, radiation therapy technologists, and nuclear medicine technologists. The proposed amendments will 1) clarify a definition; 2) increase the continuing education requirements from 6 to 12 hours and for general x-ray machine operators to increase the supervised clinical practice from 4 to 6 hours; 3) increase educational requirements for general x-ray machine operators from 12 to 24 hours; 4) authorize additional accrediting institutions for general x-ray machine operator educational programs; and 5) clarify licensing requirements for the
performance of digital radiography.
· By authority of R.C. 3748.04, to amend rules 3701:1-66-01, 3701:1-66-02, and 3701:1-66-17 of the O.A.C, pertaining to radiation-generating equipment requirements and quality assurance. Besides adding and clarifying definitions, the proposed amendments 1) add requirements for structural shielding prior to construction, renovation, or a change in workload; 2) add quality assurance requirements for computed radiography; and 3) change some patient exposure limits and incorporate some new half-value layer limits.
At the hearings, persons affected by the proposed actions may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
