    In accordance with Chapter 119 of the Revised Code (R.C.) and by authority of Senate Bill (S.B.) 210 Healthy Choices for Healthy Children signed into law on June 18, 2010, the Director of the Ohio Department of Health (ODH), or his designee, will conduct a public hearing, at the time and place listed above, to consider the proposal to adopt new Ohio Administrative Code (O.A.C.) rule 3701-65-01. This rule concerns annual reporting by schools of body mass index (BMI) and weight status for kindergarten, third, fifth, and ninth graders.

     

    S.B. 210 required the board of education of each city, exempted village, local school district and the governing authority of each chartered nonpublic school to conduct BMI screenings each year for all students in kindergarten, third, fifth, and ninth grades beginning in the 2010-11 school year. O.A.C. rule 3701-65-01 would require school districts, boards or governing authorities of chartered non public schools to report aggregated BMI and weight status category and any other demographic data required by the Director, to the Department of Health by June 1 of each year in a manner prescribed by the Director of Health.

     

    At the hearing, people affected by the proposed action may appear and be heard in person, by an attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rule, if adopted or effectuated, will be unreasonable or unlawful.
