The Ohio Department of Public Safety, division of Administration, has completed a scheduled

R.C. 119.032 five-year rule review of Chapter 4501-53, "Motorcycle Safety and Education," of the Ohio Administrative Code. A public hearing, pursuant to R.C. 119.03, is scheduled to solicit public comment on the following proposed changes:

 

Amendment

 

(Definitions) - New terms added to distinguish differences in programs and between private and public providers; 4501-53-03 (Instructor Qualifications for Certificate to Teach) - A suspension, under R.C. 4511.19, has been added as a driver record entry that will preclude an applicant from qualifying for a certification to teach; 4501-53-04 (Instructor Professional Standards) - Language requiring instructor to wear proper riding gear whenever clothing with the Motorcycle Ohio logo is worn, references to Red Cross have been removed, reflecting that instructors are required to carry first aid/adult CPR cards, content reorganized to enhance readability; 4501-53-05 (Renewal of Certification to Teach) - The 2011 "Motorcycle Ohio Policy and Procedure Manual" has been added to the rule as an informational reference; 4501-53-06 (Private Provider Qualifications for Certification of Approval) - The word, "private," has been added to the term, "provider," throughout the rule to clarify the rule's applicability; 4501-53-07 (Public Provider Qualifications for Certification of Approval) - A grant application process has replaced the request for proposal process; 4501-53-09 (Renewal of Private Provider Certification of Approval) - The word, "private," has been added to the term, "provider," throughout the rule to clarify the rule's applicability; and 4501-53-13 (Private Provider Insurance) - The word, "private," has been added to the term, "provider," throughout the rule to clarify the rule's applicability.

 

Adoption

 

                                    (Basic Rider Course) - Simultaneously rescinded and filed as new, the new content was reorganized to enhance consistency and readability; 4501-53-12 (Basic Rider Course Two) - Simultaneously rescinded and filed as new, the title of this course was changed from "Experienced Rider Course" and the content has been reorganized to enhance consistency and readability; 4501-53-14 (Basic Rider Course for the Returning Rider) - Establishes the general provisions for course instruction; 4501-53-15 (Advanced Rider Course) - Establishes the general provisions for course instruction.

 

Rescission

 

4501-53-02 (Basic Rider Course) - Rule simultaneously rescinded and filed as new, under this same rule number due to LSC formatting requirements; and 4501-53-12 (Experienced Rider Course) - Rule simultaneously rescinded and filed as new, under this same rule number due to LSC formatting requirements.
