    5101:2-12-06               Procedures for renewal of a child care center license.

     

     

     

    (A)The department shall mail the JFS 01210 "Application for Child Care License" (rev. 01/2007) and all other required forms for renewal of a license to the center at least one hundred twenty calendar days prior to the expiration date of the license.

     

    (B)(A) The person, firm, organization, institution, or agency responsible for renewal of a license shall, complete and submit the JFS 01210 A"Application for Child Care License" (rev. 8/2008) and all other required forms, and payment of the a license renewal fee of fifty dollars at least sixty calendar days prior to the expiration date of the current license. The application shall be considered filed with the department the Ohio department of job and family services (ODJFS) as of the date it is postmarked. An application received by means other than the postal service shall be considered filed when it is time/date stamped by the department ODJFS. Any application submitted without complete and/or accurate information must shall be amended with complete and/or accurate information.

     

    (C)(B) When the department ODJFS does not receive the application and fee at least sixty days prior to the expiration date of the current license, the following shall occur: license shall not be renewed and the person responsible for renewal of a license shall complete and submit a JFS 01210 for an initial application. An initial license shall not be issued until all requirements for an initial application have been met.

     

    (1)The center must pay a late fee of one hundred fifty dollars, in addition to the fifty dollar license renewal fee, for a total of two hundred dollars, and the application must be filed with the department no later than the expiration date of the current license. .

     

    (2)A renewal application and fee filed with the department after the expiration date of the current license must include a total fee of three hundred dollars, this includes a one hundred dollar fee in addition to the fifty dollar renewal fee and the one hundred fifty dollar late fee.

     

    (3)The center loses all legal rights to continue to do business at the licensed location after the expiration date of the current license if the application and license renewal fees are not filed with the department in compliance with the requirements of this rule.

     

    (D)(C) Failure to file an application for renewal of a license prior to the expiration date of the current license renders the current license invalid as of the license expiration date. The center:

     

    (1) Loses all legal rights to continue to do business at the licensed location after the expiration date of the current license if the application and license renewal fee is not filed with the department in compliance with the requirements of this

     

     

    rule.

    (1)(2)  Has  no  rights  to  an  appeal  through  the  administrative  hearing  process pursuant to section 5104.03 and Chapter 119. of the Revised Code.

    (2)(3) Shall be subject, after the license expiration date, to any penalty that could be assessed under section 5104.99 of the Revised Code.

    (E)(D) Upon receipt of an application for renewal of a license, the department After the application for renewal is submitted shall inspect the center the center shall receive an inspection by ODJFS for compliance with Chapter 5104. of the Revised Code and Chapter 5101:2-12 of the Administrative Code, and provide. The center shall correct any noncompliances in a the written inspection report by the date noted in the report and submit all documentation requested in the inspection report to the licensee and administrator after the inspection. The written inspection report shall include the following:

    (1) A statement of the noncompliance findings.

    (2) What action must be taken by the applicant to achieve compliance.

    (3) The date the department must receive verification of compliance.

    (F)(E) Following the inspection, if the departmentIf the center meets all of the determines that all requirements are in of Chapter 5104. of the Revised Code and Chapter 5101:2-12 of the Administrative Code compliance, the department ODJFS shall renew the license for a period of two years.
