111-13-01 Compensation of Precinct Officials.
(A)Definitions.
For purposes of this rule:
(1)"Fair Labor Standards Act" or "Act" means the "Fair Labor Standards Act of 1938," 52 Stat. 1062, 29 U.S.C.A. 201, as amended.
(2)"Full election day" means the period of time between the opening of the polls and the completion of the procedures contained in section 3501.26 of the Revised Code.
(B)Compensation of Precinct Officials.
Upon learning of any amendments to the Fair Labor Standards Act that increases the minimum hourly rate, the secretary of state shall establish a new maximum per diem of compensation that may be paid to judges of an election. At such time, the secretary of state shall determine the percentage the minimum hourly rate has been increased under the Fair Labor Standards Act. The secretary of state shall use this percentage to set a new maximum amount of per diem compensation, which shall be the amount established under R.C. 3501.28, increased by the same percentage that the minimum hourly rate has been increased under the Act.
(C)Notification to the boards of elections of compensation changes.
The secretary of state shall notify the boards of election by directive of the new maximum amount of per diem compensation within two business days of establishing the new amount.
