Notice is hereby given that the Ohio Department of Public Safety, Division of State Highway Patrol, intends to consider the proposal to rescind and simultaneously adopt Rule 4501-29-01 of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code.

 

The proposal to rescind and simultaneously adopt Rule 4501-29-01 (Equipment of snowmobiles, off-highway motorcycles, and all-purpose vehicles) is based on a scheduled R.C. 119.032 five-year rule review.

 

Rescission of 4501-29-01 is due to formatting requirements established by the Legislative Services Commission as more than fifty percent of this rule's content has been changed.

 

Adoption of 4501-29-01 - Changes from the original version of this rule include the removal of language originally found in paragraphs (A)(1) and (A)(2), (B)(1), (C), (C)(2), and (D), as it was duplicative of that which is found in R.C. 4519.20; paragraph (C)(3) and its reference to a Society of Automotive Engineers standard was removed; and finally, the website address where readers can access FMVSS 571.122, incorporated by reference in paragraph (B)(3), has been updated.

 

Any persons affected by the proposed rescission and adoption of this rule may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed actions will be unreasonable or unlawful.
