4501:1-1-11                 Failure of driver examination.

 

 

 

(A)    If a person fails part one of the examination prescribed in paragraph (A) of rule 4501:1-1-08 of the Administrative Code pertaining to vision, no further examination shall be granted unless adequate evidence of sufficient visual improvement has been submitted. If a person fails either part two or three of the examination prescribed in paragraph (A) of rule 4501:1-1-08 of the Administrative Code or either part of the examination prescribed in rule 4501:1-1-10 of the Administrative Code, the person may retake such test or tests three additional times at his request.

 

(B)   If a person fails the vision test or the color blindness test prescribed in paragraph (B) of rule 4501:1-1-08 of the Administrative Code, no further examination shall be given unless adequate evidence of sufficient visual improvement has been submitted. If a person fails the written test of general commercial driver knowledge or any of the applicable tests for special endorsements the person may retake each such test or tests three additional times upon each temporary permit issued to him. A person who fails any written test shall be required to wait at least one day prior to retaking such test.

 

(C)   If a person fails any of the three parts of the commercial driver's skills test prescribed in rule 4501:1-1-28 of the Administrative Code, the person may retake such test or tests three additional times upon each temporary permit issued to him. The person shall not be required to retake any such test the person has passed during the period that the person's temporary permit is valid. A person who fails a skills test shall be required to wait at least seven days prior to retaking such test.

 

(D)   No person shall be granted more than two commercial driver's temporary instruction permits within any twenty-four month period.
