    3301-102-08                Standards for measuring sponsor compliance with applicable laws and rules.

     

     

     

    (A)The department shall develop and implement a sponsor evaluation system in accordance with section 3314.016 of the Revised Code. As part of this system, the department shall rate each entity that sponsors a community school by measuring three components that include the academic performance of students, adherence to quality sponsoring practices and monitoring their schools' compliance with applicable laws and rules.

     

    (B)A sponsor's rating under this rule will be based upon verification by the department that the sponsor has monitored its community schools' adherence to applicable laws and rules covering the areas of health and safety, education program, finance, governance and school operations.

     

    (1)Pursuant to division (D)(1) of section 3314.03 of the Revised Code, sponsors are required to monitor their schools' compliance with all laws and rules applicable to their schools.

     

    (2)The compliance items to be reviewed will be selected from those laws and rules required of all community schools under section 3314.03 of the Revised Code, in consultation with a representative group of entities sponsoring community schools and other stakeholders.

     

    (3)The verification by the department shall consist of a document and onsite review for randomly selected community school(s) representing a ten per cent sample of each sponsor's cohort of schools.

     

    (C)The department's protocol for reviewing a sponsor's monitoring of its schools' compliance with laws and rules, including the list of compliance items selected to be verified as referred to in paragraph (B) of this rule, will be posted on the department's website (education.ohio.gov) and shared with each sponsor prior to initiating the sponsor compliance review, which is part of the sponsor evaluation system.

     

    (D)Based upon the findings from the compliance review, each sponsor shall receive a rating of exemplary, effective or ineffective.

     

    (1)Exemplary means that of the school(s) included in the sponsor's compliance review, the sponsor's monitoring of its schools' adherence to required compliance items could not be substantiated for less than three items if a single community school was included or an average of less than three items if multiple community schools were included.

     

    (2)Effective means that of the school(s) included in the sponsor's compliance review, the sponsor's monitoring of its schools' adherence to required compliance items could not be substantiated for three or four of the items if a single community school was included or an average of three to four items if

     

     

    multiple community schools were included.

    (3) Ineffective means that of the school(s) included in the sponsor's compliance review, the sponsor's monitoring of its schools' adherence to required compliance items could not be substantiated for more than four of the items if a single community school was included or an average of more than four of the items if multiple community schools were included.
