    5101:2-14-01               Definitions for terms used in Chapter 5101:2-14 or 5101:2-16 of the Administrative Code certification of type B home providers and in-home aides.

     

     

     

    (A) "Absentee day" means any day that a child is authorized to be in care but is not in attendance, and child care would have been provided had the child been present with the child care provider.

     

    (A)(B) "Adult residing in the home" for the purpose of certification of type B homes and in-home aides, means any person eighteen years of age or older who is a permanent resident of a certified type B family child care in the home, or any person eighteen years of age or older who resides in the home of an applicant applying for certification as a type B family child care home provider.

     

    (B)(C) "Agency inspected limited certification (AI)" (AI) means the CDHS CDJFS is required to inspect the providers home for compliance with limited certification requirements and obtain criminal records check as defined in paragraph (G) (J) of this rule.

     

    (C)(D)  "Applicant"  shall  mean  means  a  person  who  is  applying  for  professional certification or limited certification as a type B home provider or in-home aide.

     

    (E)"Border state child care provider" means a child care provider that is licensed, certified, or otherwise approved by that state to provide child care services. A border state child care provider may provide publicly funded child care only to a recipient who resides in an Ohio county that borders the state in which the provider is located.

     

    (F) "Caretaker" for the purpose of child care eligibility, means the father or mother of a child, an adult who has legal custody of a child, an adult who is the guardian of a child, or an adult who stands in loco parentis with respect to a child, and whose presence in the home is needed as the caretaker of the child. Caretaker has the same meaning as "caretaker parent" as defined in division (E) of section 5104.01 of the Revised Code.

     

    (D)(G) "Child care" means administering to the needs of infants, toddlers, preschool children, and school children outside of school hours by persons other than their caretaker parents for any part of the twenty-four hour day. Child care also means "child day care" as defined in section 5104.01 of the Revised Code.

     

    (E)(H) "County department of human services job and family services" means the county department of human services (CDHS) county department of job and family services (CDJFS) or agencies authorized to be its representative.

     

    (F)(I) "County director" means the director of the county department of human services

     

     

    job  and  family  services  or  individuals  and  agencies  authorized  to  be  his representative.

    (G)(J) "Criminal records check" means any criminal records check conducted by the superintendent of the bureau of criminal identification and investigation (BCII) pursuant to division (B) of section 109.572 of the Revised Code.

    (H)(K) "Department" and "Department of Human Services job and family services" means the Ohio department of human services job and family services (ODJFS).

    (I)(L) "Director" or "director of human services job and family services" means the director of the Ohio department of human services job and family services, or individuals or agencies authorized to act as his representative.

    (J)(M) "Emergency child care" means the provision of child care services provided for a maximum of one day by a CDHS CDJFS approved emergency caregiver due to an unplanned absence by the certified type B family child care home provider or certified in-home aide as a result of unanticipated circumstances such as illness, accident or other family crisis. Emergency child care shall not exceed one day at any one time.

    (K)(N)  "Field  trips"  means  infrequent  or  irregularly  scheduled  excursions  from  the certified type B home or from the child's own home with an in- home aide.

    (L)(O) "Food supplement" means a vitamin, mineral, or combination of one or more vitamins, minerals and/or energy-producing nutrients (carbohydrate, protein or fat) used in addition to meals or snacks.

    (M) "Handicapped" means one who has a physical or mental impairment which substantially limits one or more major life activities as determined by a licensed physician or licensed or certified psychologist.

    (N)(P) "Infant" means a child under eighteen months of age.

    (O)(Q) "In-Home Aide (IHA)" (IHA) means a person who provides child care to a child in a child's own home pursuant to Chapter 5104. of the Revised Code.

    (P) "Limited certification" means certification of an in-home aide or type B family child care home provider who are adults and who provide child care services for eligible children who are great-grandchildren, grandchildren, nieces, nephews or siblings of the provider, or whose caretaker parent is a grandchild, child, niece, nephew or sibling of the provider or a type B family child care home provider who provides child care services to eligible children all of whom have the same caretaker parent

    and who meet the standards for limited certification in accordance with Chapter 5101:2-14 of the Administrative Code.

    (R) "Limited certification" means certification of either of the following who meet the standards for limited certification in accordance with Chapter 5101:2-14 of the Administrative Code:

    (1) A type B home provider or in-home aide who is an adult and who provides child care services for eligible children who are great-grandchildren, grandchildren, nieces, nephews or siblings of the provider, or whose caretaker is a grandchild, child, niece, nephew or sibling of the provider. The type B home provider can care for children of more than one family, not to exceed six children, when all the children are related to the provider as described above; or

    (2) A type B home provider or in-home aide who provides child care services to eligible children all of whom have the same caretaker.

    (Q)(S) "Medication" is defined as any substance or preparation which is used for the purpose of prevention or treatment of an injury illness or disease.

    (R)(T) "Parent/Provider Inspected" "Parent/provider inspected limited certification (PPI)" means the parent and provider complete an inspection of the provider's home and verify in writing that the provider's home is in compliance with health and safety requirements in accordance with ODHS 1642 JFS 01642 "Type B Family Child Care Home Limited and In-Home Aide Limited Certification Application and Health/Safety Inspection Form." The provider and all adults in the home are exempt from the criminal records check.

    (U) "Preschool child" means a child who is three years old or older but is not a school child.

    (S)(V) "Professional certification" means certification given to the provider has met the requirements of Chapter 5104. of the Revised Code and rules 5101:2-14-01 to 5101:2-14-40 who meets the standards for professional certification in accordance with Chapter 5101:2-14 of the Administrative Code.

    (T)(W) "Provider" in Chapter 5101:2-14 of the Administrative Code means a person who operates a certified type B family child care home or serves as an a certified in-home aide.

    (U)(X) "Provisional" means a sixty-day period during which limited certification status is granted when the parent and provider have signed a declaration under oath attesting that the home meets the health and safety standards for limited certification.

    (V)(Y) "Publicly funded child care" means administering to the needs of infants, toddlers, preschool children, school children up to age thirteen and children eligible for special needs or protective child care up to age eighteen during any part of the twenty-four hour day by persons other than their caretaker parent for renumeration remuneration wholly or in part with federal or state funds, including child care block grant funds, distributed by the department of human services job and family services.

    (W)(Z) "Related to the provider" for the purpose of determining group size in a type B home, means any of the following persons when determining group size in a type B home: grandchildren, daughters, sons, step daughters, step sons, sisters, brothers, step sisters, step brothers, nieces, nephews, half brothers, half sisters, or first cousins who are related to the provider by blood, marriage or adoption.

    (X)(AA) "Routine trips" means frequent or regularly scheduled excursions from the certified type B family child care home or the home in which in-home aide services are being provided. Routine trips include, but are not limited to, taking a child to school or picking up a child from school.

    (BB) "School child" means a child who is enrolled in or is eligible to be enrolled in a grade of kindergarten or above, but who is less than fifteen years old, or who is less than eighteen years old and eligible for special needs or protective child care benefits.

    (CC) "Special needs" means providing child care services to a child who is under eighteen years old who does not function according to age appropriate expectations in one or more of the following areas of development: social/emotional, cognitive, communication, perceptual-motor, physical, or behavioral development, or the child has chronic health issues. The child's delays/condition(s) affect development to the extent that the child requires special adaptations, modified facilities, program adjustments or related services on a regular basis in order to function in an adaptive manner.

    (Y)(DD) "Substitute child care" means the provision of child care services by a CDHS CDJFS approved substitute caregiver due to a planned absence, not to exceed fourteen consecutive days at any one time, by the provider as a result of vacations or scheduled appointments.

    (EE) "Toddler" means a child who is at least eighteen months of age but is less than three years of age.

    (Z)(FF)  "Type  B  family  child  care  home"  and  "type  B  home"  means  a  permanent residence of the provider in which child care is provided for one to six children at

    one time and in which no more than three children are under two years of age.

    (1)   In counting children for the purposes of this rule For the purpose of determining group size in a type B home, any children under six years of age who are related to the provider, pursuant to paragraph (Z) of this rule, and who are on the premises of the type B home shall be counted. Children six years of age or older who are related to the provider, who are not publicly funded and who are on the premises of the type B home shall not be included in this count. When a provider is providing publicly funded child care for children who are related, pursuant to the definition contained in paragraph (W) (Z) of this rule, the CDHS CDJFS shall include these children in the count.

    (2)   A "Type B home" also includes a home which is the permanent residence of the provider and the parent.
