5101:2-14-04 Issuance and renewal of a certificate for professional certification as a type B home provider or in-home aide.
(A)The CDJFS shall provide the applicant with the following information when a determination is made that the applicant will be certified:
(1) JFS 08087 "Communicable Disease Chart";
(2) JFS 01940 "First Aid";
(3) All forms required to comply with the record keeping requirements contained in rules 5101:2-14-26 and 5101:2-14-28 of the Administrative Code.
(A)Upon receipt of an application for certification from a type b family child care homeor an in-home aide, the CDHS shall inspect and investigate and, if the home orindividual complies with Chapter 5101:2-14 of the Administrative Code andChapter 5104. of the Revised Code. Certify the type B home or in-home aide andissue a certificate which indicates approval to provide publicly funded child care.(B)The certificate shall be valid for twelve months, unless:(1) It is revoked for noncompliance with Chapter 5101:2-14 of the Administrative Code;
(2) The provider notifies the
county directorCDJFS of his/her voluntary withdrawal from the certification program; or(3) The type B home provider moves to a new address.
(C)The type B home provider shall post theODHS 1927 "Child Care Certificate"certificate in the home in a conspicuous place that is accessible toparentsthe caretaker at all times. TheCDHSCDJFS shall provide a copy of the certificate to the caretakerparentof a child receiving in-home aide services.(D)A certificate is valid only for the provider, address, and maximum number of children designated on the certificate.(E)If the type B home provider moves,the CDHS shall issuea new certificate and contract shall be issued to the new address upon determining that the provider is in compliance at the new address. The provider shall not be eligible for reimbursement for publicly funded child care services untilthe CDHS issues thenew certificate for the new addressa new certificate is issued.(F)The voluntary surrender of a certificate to theCDHSCDJFS or the withdrawal of anapplication for certification shall not prohibit the
CDHSCDJFS from revoking a certificate orfromdenying an application for certification, if the type B home provider or in-home aide is out of compliance with Chapter 5101:2-14 of the Administrative Code or Chapter 5104. of the Revised Code.(G)TheCDHSCDJFS shall renew a certificate, which shall be valid for twelve months, when the provider remains in compliance with Chapter 5101:2-14 of the Administrative Code. The CDJFS may choose not to renew a certificate for providers who have not provided child care services for more than six months.(H)TheCDHSCDJFS shall not prohibit, as a condition of certification, type B home providers from simultaneously providing privately or publicly funded child care servicesand child care for children whose care is not publicly funded. The requirements contained in Chapter 5101:2-14 of the Administrative Code apply to all certified type B homes providing care that is privately or publicly funded.(I) An individual certified by the
CDHSCDJFS as atype b family child caretype B home provider or as an in-home aide to provide publicly funded child care services is an independent contractor and is not an employee of theCDHSCDJFS that issued the certificate.Effective: 04/01/2003
