5101:2-14-14 Transportation and field trip safety for a licensed type B home provider.

    5101:2-14-14               Emergency child care and substitute child care for professional certification as a type B home provider or in-home aide.

     

     

     

    (A)   Each type B home provider or in-home aide shall designate an individual to serve as their emergency or substitute caregiver. This person may be the same individual if he/she will serve in both capacities. The home provider or in-home aide shall maintain the JFS 01923 "Emergency/Substitute Caregiver Statement" on file in the type B home or home of a child receiving in-home aide services. The certified type B home provider or in-home aide may use an emergency caregiver for unplanned absences or a substitute caregiver for planned absences provided that the emergency caregiver or substitute caregiver meets shall meet all of the following requirements:

     

    (1)  Is at least eighteen years of age;

     

    (2)   Signs the ODHS 1301, JFS 01301 "Child Care Convictions Statement" attesting that he/she has not been convicted of or pleaded guilty to any offense listed in division (A)(1) of section 5104.09 of the Revised Code and that no child has been removed from his/her home pursuant to section 2151.353 of the Revised Code;

     

    (3)       Have Has a criminal records check conducted as prescribed in rule 5101:2-14-101 5101:2-14-11 of the Administrative Code;

     

    (4)   Provides a safe and healthy environment when children are present;

     

    (5)    Ensures that any individual whose behavior or health endangers the health, safety and well-being of children are not present while child care is being provided; and

     

    (6)   Has immediate access at all times to a working telephone on the premises.; and

     

    (7)For those individuals who are approved as emergency/substitute caregivers on or after April 1, 2003, completes within three months of the date provided on the JFS 01923 "Emergency/Substitute Caregiver Statement", the "Health and Safety in Family Child Care" course which has been approved by the Ohio department of job and family services.

     

    (B)    The CDHS CDJFS shall request that the home provider or in-home aide give the following forms items to each prospective emergency caregiver and substitute caregiver the home provider or in-home aide intends to use to seek completion and return to the CDHS CDJFS:

     

    (1)  ODHS 1301, JFS 01301 "Child Care Convictions Statement;" and

     

     

    (2)   BCII prescribed criminal records check form and the standard impression sheet along with a statement regarding the fee for conducting a criminal records check. Items necessary to complete the BCII criminal records check; and

    (3) Type B home certification rules.

    (C)   Emergency child care and substitute child care shall only occur in a certified type B family child care home or the home of a child receiving in-home aide services. Emergency child care shall not exceed one day at any one time, and substitute child care shall not exceed fourteen consecutive days at any one time.

    (D)   The home provider or in-home aide shall contact parents the caretaker immediately when an emergency caregiver shall be used for unplanned absences of short duration caused by unanticipated circumstances such as illness, accident or other family crises. The home provider or in-home aide shall notify the CDHS CDJFS, according to CDJFS procedures, by the next working day when an emergency caregiver was used. Failure of proper notification may result in revocation of the certificate.

    (E)   The home provider or in-home aide shall contact the parent caretaker and the CDHS CDJFS, according to CDJFS procedures, prior to all planned absences when a substitute caregiver will be needed. The CDJFS may deny the use of substitute care. Failure of proper notification may result in revocation of the certification. The following information shall be discussed:

    (1)   Date substitute care is needed;

    (2)    Name of the substitute caregiver that either the parent caretaker or provider shall use; and

    (3)   Location where substitute care will be provided.

    (F) If the parent or provider is unable to arrange for emergency child care or substitute child care the provider shall notify the CDHS. The CDHS will then be responsible for locating an emergency caregiver or substitute caregiver who meets the requirements outlined in paragraph (A) of this rule.

    (G) When the provider is unable to comply with the requirements contained in paragraph (F) of this rule because the CDHS is closed, then the provider shall contact the parent and request he pick up his child.

    (H)The CDHS may deny the use of substitute care.

    (I)(F) The home provider or in-home aide shall ensure that the emergency caregiver or substitute caregiver has the following information at the time child care services are provided:

    (1)   Telephone number where parents the caretaker can be reached for each child in care;

    (2)   Telephone number of the home provider or in-home aide;

    (3)   Location of first aid supplies;

    (4)   Emergency transportation authorization JFS 01297 "Emergency Transportation Authorization"; and

    (5)   Children's health records JFS 01932 "Child's Health Record".

    (J)(G) The CDHS CDJFS may exercise the option of compiling and disseminating a list of emergency caregivers or substitute caregivers who meet the requirements of paragraph (A) of this rule to applicants or providers in order to comply with the requirements set forth in rule 5101:2-14-101 5101:2-14-11 of the Administrative Code.

    (K) The provider shall maintain the ODHS 1923, "Emergency/Substitute Caregiver Statement" on file in the type B home or home of a child receiving in-home aide services.
