In accordance with Chapter 119 of the Revised Code, the Public Health Council (PHC) will conduct two public hearings beginning at 10:00 a.m. on Thursday, May 1, 2008, in the 8th Floor Conference Room of the Ohio Department of Health (ODH), 246 N. High Street, Columbus, Ohio. The hearings concern the following rules and actions:

 

HEARING #1: By authority of Revised Code 3701.34 and 3711.02, the PHC proposes to amend Ohio Administrative Code (OAC) rules 3701-7-02, -04 to -06, and -08 to -13. These rules, pertaining to maternity hospitals, are being considered due to five-year review. The proposed amendments make grammatical corrections and ensure consistency with professional standards by correcting errors in internal cross-references. The most substantive changes amend the holding nursery requirements of rule 3701-7-

05. Previous versions of this rule have incorrectly referenced requirements for holding nurseries. The rule has been corrected to require baby holding nurseries to meet the requirements of paragraphs (A), (C)(1), and (C)(7) of the rule. Additionally, the staff tuberculosis testing requirements in paragraph (D) of rule 3701-7-10 have been updated to allow for blood assay tuberculosis testing in addition to two-step Mantoux testing.

 

HEARING #2: By authority of Revised Code 3748.02 and 3748.04, the PHC proposes to amend Appendix A to rule 3701:1-40-17 of the OAC. Rule 3701:1-40-17 sets the requirements and standards for financial assurance that certain radioactive material licensees must meet. The PHC proposes to amend Appendix A to the rule to add Cobalt- 57 to the list upon which financial assurance requirements are based. The appendix is further proposed for amendment to change the heading of the first column from "Material" to "Radionuclide" and to add a column of SI units for each radionuclide listed. Various spelling errors in the appendix are also proposed for correction. No changes are proposed to the text of rule 3701:1-40-17 or to appendices B through F.

 

At the hearings, people affected by the proposed actions may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
