    Pursuant to section119.03 of the Ohio Revised Code, the Ohio Department of Public Safety, Office of Criminal Justice Services, will conduct a public hearing for the purpose of soliciting comments on proposed changes to Chapter 4501-7, "Commercial Driver Training Schools," of the Ohio Administrative Code.

     

    The purpose of the proposed changes is to implement provisions of HB487, 129th General Assembly, that authorize the Director of Public Safety to adopt rules governing online driver education courses that beginning drivers under the age of eighteen may complete via the Internet in lieu of the twenty-four hours of in-person classroom instruction required under prior law.

     

    The proposed rules set forth the requirements for driver training provided to students and for the licensing of driver training schools and instructors. Proposed changes establish the eligibility, application, and licensing requirements for online providers, as well as the requirements for issuing certificates of completion and certificates of successful enrollment in online programs, final examinations, curriculum content, and infrastructure and security measures of online driver education instruction.

     

    Rules proposed for Amendment

     

    4501-7-01 (Definitions); 4501-7-03 (Character and fitness for class "D" license schools); 4501-7-05 (Application and renewal of license for instructors and training managers of a class

    "D" license school); 4501-7-06 (Qualifications for instructing persons with a disability for class "D" license schools); 4501-7-07 (Employees of the department and a class "D" license school); 4501-7-08 (Insurance and bonding for training the operation of class "D" motor vehicles);

    4501-7-12 (Class "D" license school training agreements); 4501-7-18 (Advertising and soliciting business by a class "D" license school); 4501-7-19 (Prohibition of guarantees by a class "D" license school); and 4501-7-21 (The director may take action against a license of a class "D" license school, training manager, or instructor).

     

    Rules proposed for Rescission/Adoption

     

    As changes to each of the following rules strike approximately half of the existing text while adding a comparable amount of new text (fifty percent guideline), each are being simultaneously proposed for rescission and adoption under the same rule number:

     

     

     

     

     

     

     

     

    4501-7-02 (Place of business for a class "D" and online license school and office); 4501-7-04 (Application for and renewal of class "D" and online school licenses); 4501-7-10 (Training required for the operation of class "D" motor vehicles); 4501-7-13 (Records for online and class "D" licensed schools); and 4501-7-20 (Inspections and investigations of class "D" and online license schools).

    Any persons affected by the proposed actions may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing.

    Persons may offer and examine witnesses and present evidence to show that the proposed actions will be unreasonable or unlawful.
