(A)Title and term. Ohio lottery commission game number three hundred four, "Firecracker Cash," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number three hundred four.

 

(B)General design.

 

(1)Game  number  three  hundred  four  is  a  key  number  match  game  with  two additional instant win features and is generally known as an "instant lottery."

 

(2)Holders of valid tickets will remove the covering of the entire play area to reveal two "Winning Numbers," ten "Your Numbers" and ten corresponding prize values. If the player matches any one or more of "Your Number(s)" to one or both of the "Winning Number(s)," the player wins the prize value shown below the matching "Your Number(s)." If the player reveals a "Star" symbol in any of the "Your Numbers" play spots, the player wins its corresponding prize value automatically. If the player reveals a "Firecracker" symbol in any of the "Your Numbers" play spots, the player wins four times the corresponding prize value. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.

 

(3)As used in this rule, "prize award" shall mean one of the following monetary amounts which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, seven dollars, seventeen dollars, fifty-one dollars, seventy-six dollars, seven hundred sixty dollars and seventeen thousand seven hundred sixty dollars. Each ticket in game number three hundred four shall be imprinted in such a way that prize awards from the set listed above may be won.

 

(C)Price of tickets. The price of a ticket issued by the commission in game number three hundred four shall be two dollars.

 

(D)Structure, nature and value of prize awards.

 

(1)There shall be one type of prize in game number three hundred four called a "regular prize award."

 

(2)The only "prize values" which shall appear on a ticket in game number three hundred four are: one dollar, two dollars, three dollars, four dollars, seven dollars, seventeen dollars, thirty-four dollars, fifty-one dollars, seventy-six dollars, seven hundred sixty dollars and seventeen thousand seven hundred sixty dollars. Prize values and play symbols shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the

 

 

underlying prize values and play symbols.

(a) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Star" symbols are revealed for one dollar two times shall win a regular prize award of two dollars;

(b) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for two dollars once shall win a regular prize award of two dollars;

(c) Holder of a valid winning ticket on which a "Firecracker" symbol is revealed in one of the "Your Numbers" play spots for one dollar four times shall win a regular prize award of four dollars;

(d)Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for four dollars once shall win a regular prize award of four dollars;

(e) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Star" symbols are revealed for two dollars two times shall win a regular prize award of four dollars;

(f)Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers," or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination of four matched numbers or "Star" symbols are revealed for one dollar four times shall win a regular prize award of four dollars;

(g) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for four dollars once shall win a regular prize award of four dollars;

(h) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Star" symbols are revealed for three dollars once and four dollars once shall win a regular prize award of seven dollars;

(i) Holder of a valid winning ticket on which one or both of the "Winning

Numbers" are matched by three of "Your Numbers," or a "Star" symbol is revealed in three of the "Your Numbers" play spots, or any combination of three matched numbers or "Star" symbols are revealed for one dollar once, two dollars once and four dollars once shall win a regular prize award of seven dollars;

(j) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers," or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination of four matched numbers or "Star" symbols are revealed for one dollar once and two dollars three times shall win a regular prize award of seven dollars;

(k) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for seven dollars once shall win a regular prize award of seven dollars;

(l) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by six of "Your Numbers," or a "Star" symbol is revealed in six of the "Your Numbers" play spots, or any combination of six matched numbers or "Star" symbols are revealed for two dollars five times and seven dollars once shall win a regular prize award of seventeen dollars;

(m) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers," or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination of five matched numbers or "Star" symbols are revealed for one dollar once and four dollars four times shall win a regular prize award of seventeen dollars;

(n) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for one dollar once, and on which a "Firecracker" symbol is revealed in one of the "Your Numbers" play spots for four dollars four times shall win a regular prize award of seventeen dollars;

(o) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for seventeen dollars once shall win a regular prize award of seventeen dollars;

(p) Holder of a valid winning ticket on which one or both of the "Winning Numbers"  are  matched  by  all  ten  of  "Your  Numbers,"  or  a  "Star"

symbol is revealed in all ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "Star" symbols are revealed for one dollar five times, two dollars four times and four dollars once shall win a regular prize award of seventeen dollars;

(q) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers," or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination of four matched numbers or "Star" symbols are revealed for one dollar once, two dollars once and seven dollars two times shall win a regular prize award of seventeen dollars;

(r) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers," or a "Star" symbol is revealed in three of the "Your Numbers" play spots, or any combination of three matched numbers or "Star" symbols are revealed for seventeen dollars three times shall win a regular prize award of fifty-one dollars;

(s) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Star" symbols are revealed for seventeen dollars once and thirty-four dollars once shall win a regular prize award of fifty-one dollars;

(t)Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by eight of "Your Numbers," or a "Star" symbol is revealed in eight of the "Your Numbers" play spots, or any combination of eight matched numbers or "Star" symbols are revealed for two dollars once and seven dollars seven times shall win a regular prize award of fifty-one dollars;

(u) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for fifty-one dollars once shall win a regular prize award of fifty-one dollars;

(v) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by six of "Your Numbers," or a "Star" symbol is revealed in six of the "Your Numbers" play spots, or any combination of six matched numbers or "Star" symbols are revealed for two dollars four times, seventeen dollars once and fifty-one dollars once shall win a regular prize award of seventy-six dollars;

(w)Holder of a valid winning ticket on which one or both of the "Winning

Numbers" are matched by two of "Your Numbers," or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Star" symbols are revealed for four dollars two times, and on which a "Firecracker" symbol is revealed in one of the "Your Numbers" play spots for seventeen dollars four times shall win a regular prize award of seventy-six dollars;

(x) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by eight of "Your Numbers," or a "Star" symbol is revealed in eight of the "Your Numbers" play spots, or any combination of eight matched numbers or "Star" symbols are revealed for seven dollars six times and seventeen dollars two times win a regular prize award of seventy-six dollars;

(y) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by all ten of "Your Numbers," or a "Star" symbol is revealed in all ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "Star" symbols are revealed for one dollar four times, two dollars two times and seventeen dollars four times shall win a regular prize award of seventy-six dollars;

(z) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for seventy-six dollars once shall win a regular prize award of seventy-six dollars;

(aa) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by all ten of "Your Numbers," or a "Star" symbol is revealed in all ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "Star" symbols are revealed for seventy-six dollars ten times shall win a regular prize award of seven hundred seventy-six dollars;

(bb) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for seven hundred sixty dollars once shall win a regular prize award of seven hundred sixty dollars; and

(cc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for seventeen thousand seven hundred sixty dollars once shall win a regular prize award of seventeen thousand seven hundred sixty dollars.

(E)Number of prize awards. The number of prize awards in any sales cycle of game

number three hundred four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional or returned tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;

(2) Mathematical reasoning indicates that the number of winning tickets sold per four million tickets sold in the following categories should be as follows:

(a) Eight tickets matching numbers or revealing one "Star" symbol for seventeen thousand seven hundred sixty dollars once to win seventeen thousand seven hundred sixty dollars.

(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

(a) Two tickets matching numbers or revealing one "Star" symbol for seven hundred sixty dollars once to win seven hundred sixty dollars;

(b) Two tickets matching numbers or revealing "Star" symbols, or any combination thereof, for seventy-six dollars ten times to win seven hundred sixty dollars;

(c) Ten  tickets  matching  numbers  or  revealing  one  "Star"  symbol  for seventy-six dollars once to win seventy-six dollars;

(d)Ten tickets matching numbers or revealing "Star" symbols, or any combination thereof, for one dollar four times, two dollars two times and seventeen dollars four times to win seventy-six dollars;

(e) Ten tickets matching numbers or revealing "Star" symbols, or any combination thereof, for seven dollars six times and seventeen dollars two times to win seventy-six dollars;

(f)Ten tickets matching numbers or revealing "Star" symbols, or any combination thereof, for four dollars two times, and revealing the "Firecracker" symbol for seventeen dollars four times to win seventy-six dollars;

(g) Ten tickets matching numbers or revealing "Star" symbols, or any combination thereof, for two dollars four times, seventeen dollars once and fifty-one dollars once to win seventy-six;

(h) Two hundred tickets matching numbers or revealing one "Star" symbol for fifty-one dollars once to win fifty-one dollars;

(i) Three hundred tickets matching numbers or revealing "Star" symbols, or any combination thereof, for two dollars once and seven dollars seven times to win fifty-one dollars;

(j) Three hundred fifty-six tickets matching numbers or revealing "Star" symbols, or any combination thereof, for seventeen dollars once and thirty-four dollars once to win fifty-one dollars;

(k) Four hundred tickets matching numbers or revealing "Star" symbols, or any combination thereof, for seventeen dollars three times to win fifty-one dollars;

(l) One thousand tickets matching numbers or revealing "Star" symbols, or any combination thereof, for one dollar once, two dollars once and seven dollars two times to win seventeen dollars;

(m) Two hundred fifty tickets matching numbers or revealing "Star" symbols, or any combination thereof, for one dollar five times, two dollars four times and four dollars once to win seventeen dollars;

(n) Two  hundred  fifty  tickets  matching  numbers  or  revealing  one  "Star" symbol for seventeen dollars once to win seventeen dollars;

(o) One thousand tickets matching numbers or revealing one "Star" symbol for one dollar once, and revealing the "Firecracker" symbol for four dollars four times to win seventeen dollars;

(p) Two hundred fifty tickets matching numbers or revealing "Star" symbols, or any combination thereof, for one dollar once and four dollars four times to win seventeen dollars;

(q) Two hundred fifty tickets matching numbers or revealing "Star" symbols, or any combination thereof, for two dollars five times and seven dollars once to win seventeen dollars;

(r) One thousand tickets matching numbers or revealing one "Star" symbol for seven dollars once to win seven dollars;

(s) One thousand tickets matching numbers or revealing "Star" symbols, or an combination thereof, for one dollar once and two dollars three times to win seven dollars;

(t)Two thousand tickets matching numbers or revealing "Star" symbols, or

any combination thereof, for one dollar once, two dollars once and four dollars once to win seven dollars;

(u) One thousand tickets matching numbers or revealing "Star" symbols, or any combination thereof, for three dollars once and four dollars once to win seven dollars;

(v) Two thousand tickets matching numbers or revealing one "Star" symbol for four dollars once to win four dollars;

(w)Two thousand tickets matching numbers or revealing "Star" symbols, or any combination thereof, for one dollar four times to win four dollars;

(x) Two thousand tickets matching numbers or revealing "Star" symbols, or any combination thereof, for two dollars two times to win four dollars;

(y) Two thousand tickets matching numbers or revealing one "Star" symbol for four dollars once to win four dollars;

(z) Three thousand tickets revealing the "Firecracker" symbol for one dollar four times to win four dollars;

(aa) Ten thousand tickets matching numbers or revealing one "Star" symbol for two dollars once to win two dollars; and

(bb) Twelve thousand tickets matching numbers or revealing "Star" symbols, or any combination thereof, for one dollar two times to win two dollars.

(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

(G)Frequency of prize drawings.

(1) Random imprinting of prize awards on all tickets issued in game number three hundred four shall be accomplished in a manner which complies with the commission's rules.

(2) When a ticket issued in game number three hundred four is sold or deemed sold in accordance with this rule and the covering material over any of the numbers and play symbols has been removed, the holder shall be deemed to have drawn the numbers and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day on the sales cycle of game number three hundred four in which the ticket was sold.

(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for

validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

(I)Validity of tickets.

(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game number three hundred four void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed, or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

(J) Director's conduct of game number three hundred four.

(1) The director shall conduct game number three hundred four in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number three hundred four. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

(2) Names and definitions of elements of game number three hundred four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number three hundred four and these elements may be given names or titles chosen by the commission.
