    3301-27-01                  Qualifications to direct, supervise, or coach a pupil activity program.

     

     

     

    (A)  As used in this rule:

     

    (1)    "Pupil-activity program" means a program that does not include any class or course required or offered for credit toward a pupil's promotion to the next grade or for graduation, or any activity conducted as a part of or required for such a class or course.

     

    (2)"Licensed" has the same meaning as "licensed individual" as defined in division (A)(1) of section 3313.53 of the Revised Code.

     

    (3)"Nonlicensed" has the same meaning "nonlicensed individual" as defined in division (A)(2) of section 3313.53 of the Revised Code.

     

    (4)(2) "School" means chartered public, chartered nonpublic or community school.

     

    (B)An  individual  shall  be  eligible  for  a  pupil  activity  permit  as  described  in  in paragraphs (B)(1) to (B)(5) of this rule.

     

    (1)An individual who does not hold any license, certificate, or permit issued by the state board of education is only eligible to apply for, and be issued, a three-year pupil activity permit.

     

    (2)An individual who holds only a three-year pupil activity permit as defined in section 3319.303 of the Revised Code and does not hold any other license, certificate, or permit issued by the state board of education is only eligible to apply for, and be issued, a three-year pupil activity permit.

     

    (3)An individual who holds a license, certificate, or permit other than those described in paragraphs (B)(4) or (B)(5) of this rule, is only eligible to apply for, and be issued, a three-year pupil activity permit.

     

    (4)An individual who holds a four-year resident eductor license as defined in section 3319.22 of the Revised Code, or a four-year alternative resident educator license as defined in section 3319.26 of the Revised Code is only eligible to apply for, and be issued, a four-year pupil activity permit.

     

    (5)An individual who holds a five-year professional educator license, senior professional educator license or a lead professional educator license as defined in section 3319.22 of the Revised Code is only eligible to apply for, and be issued, a five-year pupil activity permit.

     

    (B)(C) Prior to the employment of any individual, whether licensed or nonlicensed, by any  school,  to  direct,  supervise,  or  coach  a  pupil-activity  program,  the  hiring

     

     

    authority shall assure compliance with all applicable law and that the individual meets the following requirements:

    (1)     The  individual  is  competent  to  direct,  supervise,  or  coach  a  pupil-activity program. The individual's competence shall be determined by the following:

    (a)      Evidence of successful experience during which the individual has demonstrated the ability to work effectively with pupils.;

    (b)   Evidence of substantive knowledge of the pupil-activity program, such as successful completion of a college or university course on such activity program or successful experience, as determined by the board of education, in such activity program.;

    (c)   Knowledge of applicable rules and regulations established by the school.;

    (d)    Evidence of completion of the national federation of state high school associations (NFHS) fundamentals of coaching course (www.nfhslearn.com).; and

    (e) Evidence of completion of the requirements specified in paragraphs (E)(1) to (E)(4) of this rule. All requirements shall remain valid during the life of the pupil activity permit.

    (C)(D) Before hiring any individual, whether licensed or nonlicensed, to direct, supervise or coach a pupil activity program that involves athletics, routine or regular physical activity or health and safety considerations, the hiring authority shall assure that the individual has obtained a pupil-activity permit issued by the state board of education under divisions (A) and (B) of section 3319.303 of the Revised Code and paragraph (D)(E) of this rule.

    (D)(E) Any individual who directs, supervises, or coaches a pupil activity program that involves athletics, routine or regular physical activity, or health and safety considerations, as determined by the school, shall show evidence of qualification for a three-year pupil activity permit by meeting all of the requirements specified in paragraphs (D)(1) to (D)(4)(E)(1) to (E)(4) of this rule, which shall be verified by the hiring authority. Specifically, the individual:

    (1)    Is deemed to be of good moral character as defined in paragraph (L) of rule 3301-24-01 of the Administrative Code;

    (2)         SuccessfulHas    evidence    of    successful     completion    of     an     approved

    cardiopulmonary resuscitation (CPR) training course, which shall remain valid during the life of the pupil activity permit evidenced by a currently valid certificate and shall be verified by the hiring authority; and

    (3)    SuccessfulHas evidence of successful completion of a training program that is specifically focused on brain trauma and brain injury management, pursuant to section 3319.303 of the Revised Code, which shall remain valid during the life of the pupil activity permit and shall be verified by the hiring authority; and

    (4)     SuccessfulHas evidence of successful completion of one of the following, which shall remain valid during the life of the pupil activity permit and shall be verified by the hiring authority:

    (a)    A nationally recognized first-aid training program as designated on the approved list provided by the Ohio department of education (located in the pupil activity provider information packet available on the department's website at education.ohio.gov); or

    (b)   A college or university course on the health and safety of participants in a pupil activity program as approved by the Ohio department of education; or

    (c)   A two-hour first-aid training course as approved by the Ohio department of education; or

    (d)   Be the holder of a currently valid professional board license in one of the categories specified on the approved list provided by the Ohio department of education (located in the pupil activity provider information packet available on the department's website at education.ohio.gov).

    (E)(F) A first-aid training course under paragraph (D)(4)(c)(E)(4)(c) of this rule shall be pre-approved in accordance with the policies and procedures of the department of education (located in the pupil activity provider information packet information packet available on the department's website at education.ohio.gov).

    (F)(G) An individual may renew the pupil activity permit upon evidence of meeting the following:

    (1) Currently holds, or has held, a pupil activity permit of the same term length; and

    (2) Provides evidence of successful completion of of the requirements specified in

    paragraphs (E)(1) to (E)(4) of this rule, which shall remain valid during the life of the permit and shall be valid prior to a request for renewal of the permit.

    (1) Successful completion of the requirements specified in paragraphs (D)(1) and (D)(2) of this rule;

    (2) Successful completion of the requirements specified in paragraph (D)(4) of this rule, which shall have been completed within the last three calendar years prior to request for renewal of the permit; and

    (3) Successful completion, within the previous three calendar years, of a training program in recognizing the symptoms of concussions and head injuries, to which the Ohio department of health has provided a link on its website (www.odh.ohio.gov), or a training program authorized and required by an organization that regulates interscholastic conferences or events, pursuant to section 3319.303 of the Revised Code.
