    NOTICE OF PUBLIC RULES HEARING

    In accordance with Chapter 119. of the Revised Code (R.C.), the Director of the Department of Health is proposing changes to the following Ohio Administrative Code (O.A.C.) rules:

     

    O.A.C. Chapter 3701-49 (Fees for Laboratory Services and 3701-55 (Genetic, Endocrine, or Metabolic Screening of Newborn Infants)

     

    By authority of R.C. 3701.221 and 3701.501, the Director proposes to amend O.A.C. rules 3701-49- 01.1, 3701-55-02 and 3701-55-04. Amendments are proposed in order to enact new legislative requirements in section 3701.501 of the Revised Code (Newborn screened for genetic, endocrine, and metabolic disorders) to include screening, and an option to forgo screening, for Krabbe disease. The following changes are proposed:

     

    3701-49-01.1 - Fees for laboratory services (variable fees) - Amended to increase the newborn screening fee to accommodate the costs for Krabbe disease screening;

     

    3701-55-02-Required screening; facility requirements - Amended to add Krabbe disease to the list of screening on the newborn screening panel and to notify the Bureau of Public Health Laboratories of a decision to forgo screening; and

     

    3701-55-04 - Notification prior to screening - Amended to allow parents the option to forgo the Krabbe screening.

     

    Previously Announced Rules that will also be on the May 19th Agenda: Vital Statistics - 3701-5-01 to -04, -07 to -12, and -16; and Radioactive Material Standards - Industrial Radiographers - 3701:1-

    4803, -05, -17, and -19.

     

    Hearing Process and Comment Opportunity:
