NOTICE OF PUBLIC RULES HEARING

In accordance with Chapter 119. of the Revised Code (R.C.), the Director of the Department of Health is proposing changes to the following Ohio Administrative Code (O.A.C.) rules:
O.A.C. Chapter 3701-5 - Vital Statistics
By authority of R.C. 3705.02 and in fulfillment of five-year review requirements, the Director of the Ohio Department of Health proposes to amend O.A.C. rules 3701-5-01 to -04, -07 to -12, and -16; to rescind current and adopt new rules 3701-5-04 to -06. These rules pertain to the Bureau of Vital Statistics and they establish forms and protocol for collecting and correcting data throughout the Vital Statistics system.
The proposed rules pertain to fees for certified copies of birth and death certificates, filing of institution and out-of-institution births, filing of death certificates, and completing and certifying cause of death. The proposed rules also specify that death certificates shall be filed within five days after the date of death. The proposed rules are being amended to add definitions, remove obsolete forms, and address circumstances where a coroner can complete the death certificate with the cause "pending." Additionally, the rules are being amended for minor language changes.
O.A.C. Chapter 3701:1-48 - Radioactive Material Standards - Industrial Radiographers
By authority of R.C. 3748.04 and in fulfillment of five-year review requirements, the Director proposes to amend O.A.C. rules 3701:1-48-03, 3701:1-48-05, 3701:1-48-17, and 3701:1-48-19. These rules
pertain to requirements for industrial radiography operations regulated by the State of Ohio. Although the entire Chapter has been reviewed, only the four rules listed above are proposed with changes. Those changes are minor: correction of Bureau name, typos, adding a connecting word, and spelling out a word previously abbreviated.
Hearing Process and Comment Opportunity:
At the hearing, people affected by the proposed actions may appear and be heard in person, by an attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
