NOTICE OF PUBLIC HEARING
The Ohio Department of Developmental Disabilities hereby gives notice of its intent to rescind and adopt the following rules of the Administrative Code on a permanent basis on or about July 1, 2016, and to conduct a public hearing thereon.
The Department is making revisions to the rule governing bed-hold days at Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICFIID). Existing rule 5123:2-7-08 entitled Intermediate Care Facilities - Coverage of Bed-Hold Days for Medical Necessity and Other Limited Absences is being rescinded and replaced by a new rule of the same number entitled Intermediate Care Facilities for Individuals with Intellectual Disabilities - Bed-Hold Days. The rule establishes requirements and procedures for an ICFIID to be reimbursed for reserving a bed for a resident who is temporarily absent. The rule is being revised to reflect a procedural change. The Department implemented changes to the ICFIID information technology system in July 2015 which allow the Department to assume from county departments of job and family services, the function of prior-authorizing bed-hold days. Additional revisions to the rule are being made to standardize use of terms and to update references to the Revised Code, the Administrative Code, and the level-of-care process. The necessary revisions affect more than 50% of the rule; therefore, the Department is proposing to rescind the existing rule and bring forth a new replacement rule.
The Department is proposing to adopt new rule 5123:2-9-39 entitled Home and Community-Based Services Waivers - Waiver Nursing Services Under the Individual Options Waiver. The rule defines Waiver Nursing Services under the Individual Options Waiver and sets forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service. Waiver Nursing Services is

currently a service available under the Transitions Developmental Disabilities Waiver. Ohio is seeking approval from the federal Centers for Medicare and Medicaid Services to add Waiver Nursing Services to the Individual Options Waiver, primarily to support approximately 1,700 individuals enrolled in the Transitions Developmental Disabilities Waiver who are transferring to the Individual Options Waiver and rely upon the service to support their continuing nursing needs.
A public hearing on the proposed rule actions will be held on May 17, 2016, beginning at 10:00 a.m., and continuing until all persons in attendance have had an opportunity to testify. The hearing will be held in the Lobby Hearing Room of the Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio 43215. At this hearing, the Department will accept verbal and/or written testimony on the proposed rule actions. Persons unable to attend the public hearing may submit written comments on the proposed rule actions.
Any written comments received on or before the public hearing date will be treated as testimony and made available for public review.
