    Pursuant to section 5164.02 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Medicaid (ODM) gives notice of ODM's intent to consider the adoption, amendment, or rescission of the rule as identified below and of a public hearing thereon.

     

    Rule 5160-1-17.1, entitled Notification of rule and program changes, is being proposed for rescission as a result of five-year rule review. The rule was put into effect when ODM was under the jurisdiction of the Ohio Department of Job and Family Services (ODJFS), and is outdated. This rule provides that, before the effective date of the final adoption, amendment, or rescission of a rule, ODJFS shall make a reasonable effort to notify persons affected. Reasonable effort means posting the full text of the rule to the ODJFS website. In addition, this rule allows ODJFS to communicate final action through email. Stakeholder rule notification is already required by section 119.03 of the Ohio Revised Code, therefore this rule is unnecessary.

     

    A public hearing on the proposed rule will be held at the date, time, and location listed at the top of this notice. Written and oral testimony will be accepted at the public hearing. Additionally, written comments received or postmarked no later than the date of the public hearing will be treated as testimony.

     

    A copy of the proposed rule is available, without charge, to any person affected by the rule at the address listed below. The rule is also available on the internet at  http://www.registerofohio.state.oh.us/.
