901-3-02 Advisory committee.

 

 

PUBLIC NOTICE

 

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed rescission of Ohio Administrative Code rule 901-3-02.

 

Ohio Administrative Code rule 901-3-02 states that the Director of the Ohio Department of Agriculture " may, subject to approval by the governor pursuant to section 121.13 of the Revised Code, appoint an advisory committee consisting of representatives of agricultural interests in the state to advise him on the disbursement of grants, gifts, devises or bequests of property made for promoting any program under the control of the department."

 

As this rule was up for five year rule review, it was decided that this rule was to be rescinded. Pursuant to Ohio Revised Code section 121.13, the Director of the Ohio Department of Agriculture, has the authority, with the approval of the Governor, to call an advisory board to aid the work of the Department. As this authority is already granted in the Revised Code, a specific Administrative Code provision outlining this power was deemed to be repetitive and unnecessary. For those reasons, it was elected that the rule be rescinded.

The hearing will be conducted in accordance with Chapter 119 of the Revised Code. Any person affected by the no change rule package may appear and be heard in person, by his attorney, or both, may present his position, arguments, or contentions, orally or in writing, offer and examine witnesses, and present evidence tending to show that the no change rule package, if adopted or effectuated, will be unreasonable or unlawful.
