    NOTICE OF PUBLIC HEARING OHIO DEPARTMENT OF PUBLIC SAFETY

    The Ohio Department of Public Safety, Office of Criminal Justice Services ("OCJS"), will conduct a public hearing for the purpose of soliciting comments on the proposed amendment of rule 4501-53-12, entitled "Basic rider course two," of the Ohio Administrative Code. The purpose of the amendment is to allow persons who hold valid temporary instruction identification cards (TIPICs) to participate in the basic rider course- two (BRC-2) of the Motorcycle Safety and Education Program operated pursuant to section

    4508.08 of the Revised Code.

     

    Rule 4501-53-12 sets forth the requirements for the structure of the BRC-2 course including minimum class time, curriculum, topic sequence, instructor-to-student ratio, maximum student capacity, endorsement requirements, safety equipment, and the use of personal and private provider motorcycles for range instruction. In addition to allowing persons who hold TIPICs to participate in the course, other proposed amendments set forth that only those students who have valid motorcycle endorsements or licenses may carry passengers and remove outdated language in paragraph (H) of the rule.

     

    Persons affected by the proposed amendment of this rule may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed rule will be unreasonable or unlawful if enacted.
