    NOTICE OF PUBLIC HEARING

     

     

    Pursuant to Chapter 119. of the Revised Code, the Ohio Department of Developmental Disabilities hereby gives notice of its intent to amend, rescind, and adopt the following rules of the Administrative Code on a permanent basis on or about July 1, 2015, and to conduct a public hearing thereon.

     

    Rule 5123:2-7-06 entitled Intermediate Care Facilities - Level of Care Review Process is being rescinded. The rule sets forth the criteria and process to determine whether an individual requires the level of care necessary to receive Medicaid-funded services from an Intermediate Care Facility for Individuals with Intellectual Disabilities.  The rule is being replaced by new rule 5123:2-8-01 (described below).

     

    Rule 5123:2-7-15 entitled Intermediate Care Facilities - Payment and Adjustment Process is being rescinded and replaced by a new rule of the same number entitled Intermediate Care Facilities for Individuals with Intellectual Disabilities - Claim Submission, Payment, and Adjustment Process. The rule establishes procedures for Intermediate Care Facilities to be paid for services rendered. The Department is rescinding the existing rule and bringing forth a new rule as necessary revisions to reflect a new process for electronic submission of claims for services provided on or after July 1, 2015, affect more than fifty percent of the rule.

     

    Rule 5123:2-8-01 entitled Developmental Disabilities Level of Care is a proposed new rule. The rule sets forth the criteria and process used to determine whether an individual requires the level of care necessary to receive Medicaid-funded services from an intermediate Care Facility for Individuals with Intellectual Disabilities or through enrollment in a Home and Community-Based Services waiver administered by the Department. The rule replaces rule 5123:2-7-06 (described above).

    Rule 5123:2-9-56 entitled Home and Community-Based Services Waivers - Personal Care Aide Services Under the Transitions Developmental Disabilities Waiver is being amended. The rule defines Personal Care Aide Services and sets forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service. The rule is being amended to adjust the billing units and payment rates to align with billing units and payment rates as set forth in rule 5160-46-06 for the same service available under the Ohio Home Care Waiver administered by the Ohio Department of Medicaid.

    Rule 5123:2-9-59 entitled Home and Community-Based Services Waivers - Waiver Nursing Services Under the Transitions Developmental Disabilities Waiver is being amended. The rule defines Waiver Nursing Services and sets forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service. The rule is being amended to adjust the billing units and payment rates to align with billing units and payment rates as set forth in rule 5160-46-06 for the same service available under the Ohio Home Care Waiver administered by the Ohio Department of Medicaid.

    A public hearing on the proposed rule actions will be held on May 15, 2015, beginning at 10:00 a.m., and continuing until all persons in attendance have had an opportunity to testify. The hearing will be held in the Lobby Hearing Room of the Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio 43215.  At this hearing, the Department will accept verbal and/or written testimony on the proposed rule actions under consideration.

    Persons unable to attend the public hearing may submit written comments on the proposed rule actions.  Any written comments received on or before the public hearing date will be treated as testimony and made available for public review.
