    DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to sections 2151.412, 5103.02, 5103.03 and Chapter 119 of the Ohio Revised Code, the director of the Department of Job and Family Services gives notice of the Department's intent to consider the amendment of rules governing children services licensing, as identified below and of a public hearing thereon.

    The following rules are being proposed for amendment in order to comply with the provisions of the five year rule review process:

    Rule 5101:2-5-04.1 entitled "Acceptance of accreditation in lieu of certification requirements" contains procedures for agencies to follow when applying for ODJFS to accept a comparable requirement of a nationally recognized accreditation organization in lieu of a certification requirement.

    Rule 5101:2-5-07 entitled "Denial or revocation of an agency's certificate or certification to perform specific functions" contains the requirements for certification of an agency by the Ohio department of job and family services.

    Rule 5101:2-5-34 entitled "PCPA and PNA case plans and administrative case reviews for direct placements" contains procedures for PCPAs and PNAs to follow with regard to case plans and administrative case reviews when the agency has accepted a direct placement of a child from a parent, guardian or custodian.

    Rule 5101:2-7-08 entitled "Alternative care arrangements" outlines the requirements for a foster caregiver to follow when an alternative care arrangement is used to provide care for the child.

    Rule 5101:2-7-10 entitled "Care of a foster child under age two" contains the requirements for a foster caregiver to follow when providing care for a foster child under the age of two years.

    Rule 5101:2-7-11 entitled "Socialization and education" contains the required information for a foster caregiver to follow in the socialization and education of a foster child.

    Rule 5101:2-7-15 entitled "Transportation" contains procedures for a foster caregiver to follow when transporting a foster child in any vehicle owned or leased by caregiver or used to transport a foster child.

    Rule 5101:2-9-02 entitled "Staffing requirements" stipulates the staffing requirements for residential facilities certified by the department.

    Rule 5101:2-9-04 entitled "General maintenance of a residential facility" contains the requirements for general maintenance of a residential facility.

    Rule 5101:2-9-05 entitled "Requirements for residential parenting facility furniture, materials and equipment; diaper changing" outlines the requirements for furniture, materials and equipment used in a residential parenting facility and procedures for diaper changing facilities.

    Rule 5101:2-9-06 entitled "General safety" contains the general safety requirements for residential facilities.

    Rule 5101:2-9-07 entitled "Emergency planning and preparedness" contains the emergency procedures to be followed by residential facilities certified by the department.

    Rule 5101:2-9-08 entitled "Fire safety" contains fire safety procedures for residential facilities certified by the department.

    Rule 5101:2-9-09 entitled "Emergency medical plan and first aid supplies" contains requirements for emergency medical plans and first aid supplies for residential facilities certified by the department.

    Rule 5101:2-9-10 entitled "Storage of hazardous materials" contains instructions for storage of hazardous materials in residential facilities certified by the department.

    Rule 5101:2-9-11 entitled "Admissions and admissions log" contains procedures for residential facilities certified by the department to follow in admitting children into care.

    Rule 5101:2-9-14 entitled "Medications" contains procedures for safe handling of medications for residential facilities certified by the department.

    Rule 5101:2-9-15 entitled "Residential facility handbook for residents and their families" contains requirements for a handbook for residents admitted to residential facilities certified by the department and their families.

    Rule 5101:2-9-16 entitled "Visiting and communication" outlines agency visitation and communication requirements for residents of residential facilities certified by the department.

    Rule 5101:2-9-17 entitled "Child's money" outlines the requirements for handling a child's money for residential facilities certified by the department.

    Rule 5101:2-9-18 entitled "Recreation and leisure activities and equipment" outlines requirements for recreation and leisure activities and equipment for residential facilities certified by the department.

    Rule 5101:2-9-19 entitled "Personal belongings, hygiene, socialization and education" outlines requirements for a child's personal belongings, and children's hygiene, socialization and education in residential facilities certified by the department.

    Rule 5101:2-9-20 entitled "Food and nutrition" outlines requirements for food and nutrition in children's residential facilities.

    Rule 5101:2-9-21 entitled "Disciplinary policy and procedures" contains the requirements governing a children's residential facility's disciplinary policy and procedures.

    Rule 5101:2-9-22 entitled "Isolation" contains the requirements for isolation rooms and isolation procedures for children residing in a residential facility.

    Rule 5101:2-9-23 entitled "Notification and documentation of critical incidents" details the notification procedures and documentation for critical incidents in a children's residential facility certified by the department.

    Rule 5101:2-9-24 entitled "Child and family complaint procedure" specifies the requirements for a children's residential facility certified by the department in the investigation and resolution of complaints from children in residence or their families.

    Rule 5101:2-9-25 entitled "Group home and residential parenting facility location and programmatic requirements for residential parenting facilities" contains requirements on the site location of group homes and residential parenting facilities and program instructions for residential parenting facilities.

    Rule 5101:2-9-26 entitled "Living rooms and lounges" specifies the requirements for living rooms and lounges in children's residential facilities certified by the department.

    Rule 5101:2-9-27 entitled "Dining areas" outlines requirements for dining areas in children's residential facilities certified by the department.

    Rule 5101:2-9-28 entitled "Bedrooms" contains the requirements for bedrooms in children's residential facilities certified by the department.

    Rule 5101:2-9-29 entitled "Bathrooms" contains the requirements for bathrooms in children's residential facilities certified by the department.

    Rule 5101:2-9-30 entitled "Kitchens and kitchen supplies" contains the requirements for kitchens and kitchen supplies in children's residential facilities certified by the department.

    Rule 5101:2-9-31 entitled "Laundry facilities"contains the requirements for laundry facilities in children's residential facilities certified by the department.

    Rule 5101: 2-9-32 entitled "Transportation" contains the requirements for transportation of infants, toddlers and other children in motor vehicles used by a children's residential facility to transport children.

    Rule 5101:2-9-33 entitled "Building approval" contains the requirements for building approvals and occupancy permits in new or renovated children's residential centers.

    A copy of these proposed rules is available without charge to any person at the address listed below. A public hearing on the proposed rule will be held on May 23, 2002 at 10:00 a.m. until all testimony is heard in the B-1 Conference Room in the basement area of the Rhodes Office Tower, 30 East Broad Street, Columbus, Ohio. Either written or verbal testimony on the proposed rule will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than May 23, 2002 will be treated as testimony.
