    NOTIFICATION OF PUBLIC HEARING

    Notice of hearing to amend Rules 4501-52-01, -02, -03,

    to rescind Rule 4501-52-05, and to adopt new Rule 4501-52-05 of the Ohio Administrative Code in accordance with

    Chapter 119. of the Ohio Revised Code

    Notice is hereby given that a hearing will be held by the Ohio Department of Public Safety for the purpose of considering the above-listed administrative rules.

    As authorized in Section 4513.52 of the Ohio Revised Code, the Department of Public Safety proposes to amend Rules 4501-52-01, -02, & -03, to rescind existing Rule 4501-52-05, and to adopt new Rule 4501-52-05 of the Ohio Administrative Code. These rules are proposed for the purpose of reorganizing, streamlining, and removing unnecessary and/or outdated language, updating information to reflect current procedures, providing criteria for application of an optional annual small bus safety inspection decal, providing contact sites for, and information regarding, the applicable versions of materials incorporated by reference in Ohio Administrative Code Chapter 4501-52, clarifying, including clarifying decal expiration dates, clarifying citations for federal regulatory information referenced in the rules, clarifying bus size with regard to front and rear identification and front and rear clearance lamps, clarifying marking and equipment requirements for buses previously registered as school buses that are to be used exclusively for other purposes, and clarifying language regarding inspection of dual use buses.

    A public hearing on the proposed rules will be held Thursday, May 6, 2004 at 2:00 p.m. in room 111 (first floor) of the Charles D. Shipley Building, Ohio Department of Public Safety, 1970 West Broad Street, Columbus, Ohio.

    Either written or oral testimony will be received at the hearing.  Additionally, written comments received at the address below before the hearing will be treated as testimony.
