    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to section 3125.25 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rule as identified below and of a public hearing thereon.

     

    Rule 5101:9-7-23, entitled Child Support Random Moment Sample Time Study, is being proposed for amendment because of the five-year rule review and to change from having child support enforcement agencies reporting "core" hours to having them report the actual agency hours for random moment sampling. The United States Department of Health and Human Services issued a directive for the change.

     

    This rule details how each child support enforcement agency will set up and submit the staff work hours to ODJFS, based upon the actual hours the agency is open; unless the agency is entering separate employee groups. If the agency has employees working flex time, the agency has the option of setting up separate employee groups. If an agency exercises this option, the separate employee groups are based on the actual hours each employee group is scheduled to work.

     

    A copy of the proposed rule is available, without charge, to any person affected by the rule at the address listed below. The rule is also available on the internet at  http://www.registerofohio.state.oh.us/. A public hearing on the proposed rule will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
