    3770:1-9-446               Game rule number four hundred forty-six.

     

     

     

    (A)Title and term. Ohio lottery commission game rule number four hundred forty-six, "3X Diamond Dazzler," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred forty-six.

     

    (B)General design.

     

    (1)Game rule number four hundred forty-six is an instant lottery game within which is contained fourteen separate "Games" and is generally known as an instant lottery. The player reveals three play symbols across in each "Game." The player must match three like play symbols in any one "Game" across to win the corresponding prize value revealed for that "Game." As a "Bonus" feature, if the player reveals a "Diamond" symbol in any one "Game" across, the player wins the corresponding prize value revealed for that "Game" automatically. If the player reveals two "Diamond" symbols in any one "Game" across, the player wins double the corresponding prize value revealed for that "Game" automatically. If the player reveals three "Diamond" symbols in any one "Game" across, the player wins triple the corresponding prize value revealed for that "Game" automatically. If the player matches three like play symbols in any one "Game" across and the corresponding prize value revealed for that "Game" is a "TPD" symbol, the player wins one thousand dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") to win a two hundred thousand dollar grand prize. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director. Play symbols may include: "Cherries," "Lemons," "Bananas," "Oranges," "Melons," "Bells," "Crowns," "Clovers," "Bars," "Pineapples," "Apples," "Grapes," "Pots of Gold;" "Gold Coins," "Stacks of Cash," "Horseshoes," "Moneybags," the number "7" symbols and "Diamonds." There are fourteen chances to win on each ticket, and a player may win up to fourteen times on one ticket.

     

    (2)As used in this rule, "prize award" shall mean any one of the  following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, eight dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, twenty thousand dollars and two hundred thousand dollars. Each ticket in game rule number four hundred forty-six shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)Price of tickets. The price of a ticket issued by the commission in game rule number four hundred forty-six shall be five dollars.

     

     

     

    (D)Structure, nature and value of prize awards.

    (1) There shall be two types of prizes in game rule number four hundred forty-six, a "regular prize award" and a "TPD" prize award.

    (2) The only "prize values" which shall appear on a ticket in game rule number four hundred forty-six are those listed as follows: one dollar, two dollars, four dollars, five dollars, eight dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, two hundred fifty dollars, five hundred dollars, the "TPD" symbol corresponding to a prize value of one thousand dollars, two thousand dollars, five thousand dollars, twenty thousand dollars and two hundred thousand dollars.

    (3) Prize values and play symbols appearing on any ticket in game rule number four hundred forty-six shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values and play symbols.

    (a) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond " symbol in one "Game" across for five dollars once shall win a regular prize award of five dollars;

    (b) Holder of a valid winning ticket matching three like play symbols in five "Games" across, or revealing a "Diamond" symbol in five "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in five "Games" across for one dollar five times shall win a regular prize award of five dollars;

    (c) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for two dollars once; and on which three "Diamond" symbols are revealed in one "Game" across for one dollar tripled shall win a regular prize award of five dollars;

    (d)Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for one dollar once; and on which two "Diamond" symbols are revealed in one "Game" across for two dollars doubled shall win a regular prize award of five dollars;

    (e) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for eight dollars once shall win a regular prize award of eight dollars;

    (f)Holder of a valid winning ticket on which two "Diamond" symbols are revealed in one "Game" across for four dollars doubled shall win a

    regular prize award of eight dollars;

    (g) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for ten dollars once shall win a regular prize award of ten dollars;

    (h) Holder of a valid winning ticket matching three like play symbols in ten "Games" across, or revealing a "Diamond" symbol in ten "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in ten "Games" across for one dollar ten times shall win a regular prize award of ten dollars;

    (i) Holder of a valid winning ticket on which two "Diamond" symbols are revealed in one "Game" across for five dollars doubled shall win a regular prize award of ten dollars;

    (j) Holder of a valid winning ticket matching three like play symbols in two "Games" across, or revealing a "Diamond" symbol in two "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in two "Games" across for two dollars once and five dollars once; and on which three "Diamond" symbols are revealed in one "Game" across for one dollar tripled shall win a regular prize award of ten dollars;

    (k) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for twenty dollars once shall win a regular prize award of twenty dollars;

    (l) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond' symbol in one "Game" across for five dollars once; and on which three "Diamond" symbols are revealed in one "Game" across for five dollars tripled shall win a regular prize award of twenty dollars;

    (m) Holder of a valid winning ticket on which two "Diamond" symbols are revealed for ten dollars doubled shall win a regular prize award of twenty dollars;

    (n) Holder of a valid winning ticket matching three like play symbols in all fourteen "Games" across, or revealing a "Diamond" symbol in all fourteen "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in all fourteen "Games" across for one dollar ten times, two dollars three times and four dollars once shall win a regular prize award of twenty dollars;

    (o) Holder of a valid winning ticket matching three like play symbols in one

    "Game" across or revealing a "Diamond" symbol in one "Game" across for fifty dollars once shall win a regular prize award of fifty dollars;

    (p) Holder of a valid winning ticket matching three like play symbols in four "Games" across, or revealing a "Diamond" symbol in four "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in four "Games" across for five dollars four times; and on which three "Diamond" symbols are revealed in one "Game" across for ten dollars tripled shall win a regular prize award of fifty dollars;

    (q) Holder of a valid winning ticket matching three like play symbols in six "Games" across, or revealing a "Diamond" symbol in six "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in six "Games" across for five dollars six times; and on which two "Diamond" symbols are revealed in one "Game" across for ten dollars doubled shall win a regular prize award of fifty dollars;

    (r) Holder of a valid winning ticket matching three like play symbols in all fourteen "Games" across, or revealing a "Diamond" symbol in all fourteen "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in all fourteen "Games" across for two dollars five times, four dollars five times and five dollars four times shall win a regular prize award of fifty dollars;

    (s) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for one hundred dollars once shall win a regular prize award of one hundred dollars;

    (t)Holder of a valid winning ticket matching three like play symbols in ten "Games" across, or revealing a "Diamond" symbol in ten "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in ten "Games" across for ten dollars ten times shall win a regular prize award of one hundred dollars;

    (u) Holder of a valid winning ticket matching three like play symbols in five "Games" across, or revealing a "Diamond" symbol in five "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in five "Games" across for five dollars five times; and on which three "Diamond" symbols are revealed in one "Game" across for twenty-five dollars tripled shall win a regular prize award of one hundred dollars;

    (v) Holder of a valid winning ticket on which two "Diamond" symbols are

    revealed in one "Game" across for fifty dollars doubled shall win a regular prize award of one hundred dollars;

    (w)Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for five hundred dollars once shall win a regular prize award of five hundred dollars;

    (x) Holder of a valid winning ticket matching three like play symbols in eight "Games" across, or revealing a "Diamond" symbol in eight "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in eight "Games" across for twenty-five dollars eight times; and on which three "Diamond" symbols are revealed in one "Game" across for one hundred dollars tripled shall win a regular prize award of five hundred dollars;

    (y) Holder of a valid winning ticket matching three like play symbols in twelve "Games" across, or revealing a "Diamond" symbol in twelve "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in twelve "Games" across for twenty-five dollars four times and fifty dollars eight times shall win a regular prize award of five hundred dollars;

    (z) Holder of a valid winning ticket on which two "Diamond" symbols are revealed in one "Game" across for two hundred fifty dollars doubled shall win a regular prize award of five hundred dollars;

    (aa) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across and a "TPD" prize symbol is revealed for one thousand dollars in that "Game," and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win two hundred thousand dollars;

    (bb) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for five thousand dollars once shall win a regular prize award of five thousand dollars;

    (cc) Holder of a valid winning ticket matching three like play symbols in ten "Games" across, or revealing a "Diamond" symbol in ten "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in ten "Games" across for five hundred dollars ten times shall win a regular prize award of five thousand dollars;

    (dd) Holder of a valid winning ticket matching three like play symbols in two

    "Games" across, or revealing a "Diamond" symbol in two "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in two "Games" across for two thousand dollars two times; and on which two "Diamond" symbols are revealed in one "Game" across for five hundred dollars doubled shall win a regular prize award of five thousand dollars;

    (ee) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars;

    (ff) Holder of a valid winning ticket matching three like play symbols in ten "Games" across, or revealing a "Diamond" symbol in ten "Games" across, or any combination of matching three like play symbols or revealing a "Diamond" symbol in ten "Games" across for twenty thousand dollars ten times shall win a regular prize award of two hundred thousand dollars; and

    (gg) Holder of a valid winning ticket matching three like play symbols in one "Game" across or revealing a "Diamond" symbol in one "Game" across for two hundred thousand dollars once shall win a regular prize award of two hundred thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred forty-six will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of wining tickets per six million tickets sold in the following prize categories should be as follows:

    (a) Two tickets winning two hundred thousand dollars once in one "Game" across to win two hundred thousand dollars;

    (b) Two tickets winning twenty thousand dollars ten times in ten "Games" across to win two hundred thousand dollars;

    (c) Twenty tickets winning twenty thousand dollars once in one "Game" across to win twenty thousand dollars;

    (d)One hundred tickets winning two thousand dollars two times in two

    "Games" across and five hundred dollars doubled in one "Game" across to win five thousand dollars;

    (e) Fifty tickets winning five hundred dollars ten times in ten "Games" across to win five thousand dollars; and

    (f)Fifty tickets winning five thousand dollars once in one "Game" across to win five thousand dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a) One ticket winning the "TPD" prize symbol to win one thousand dollars automatically in one "Game" across, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win two hundred thousand dollars;

    (b) Ten tickets winning two hundred fifty dollars doubled in one "Game" across to win five hundred dollars;

    (c) Ten tickets winning twenty-five dollars four times and fifty dollars eight times in twelve "Games" across to win five hundred dollars;

    (d)Fifteen tickets winning twenty-five dollars eight times in eight "Games" across and one hundred dollars tripled in one "Game" across to win five hundred dollars;

    (e) Fifteen tickets winning five hundred dollars once in one "Game" across to win five hundred dollars;

    (f)Two hundred fifty tickets winning fifty dollars doubled in one "Game" across to win one hundred dollars;

    (g) Two hundred fifty tickets winning five dollars five times in five "Games" across and twenty-five dollars tripled in one "Game" across to win one hundred dollars;

    (h) Two hundred fifty tickets winning ten dollars ten times in ten "Games" across to win one hundred dollars;

    (i) Two  hundred  fifty  tickets  winning  one  hundred  dollars  once  in  one "Game" across to win one hundred dollars;

    (j) Five hundred tickets winning two dollars five times, four dollars five times and five dollars four times in all fourteen "Games" across to win fifty dollars;

    (k) Six hundred tickets winning five dollars six times in six "Games" across and ten dollars doubled in one "Game" across to win fifty dollars;

    (l) Seven hundred tickets winning five dollars four times in four "Games" across and ten dollars tripled in one "Game" across to win fifty dollars;

    (m) Six hundred tickets winning fifty dollars once in one "Game" across to win fifty dollars;

    (n) One thousand tickets winning one dollar ten times, two dollars three times and four dollars once in all fourteen "Games" across to win twenty dollars;

    (o) One thousand tickets winning ten dollars doubled in one "Game" across to win twenty dollars;

    (p) One thousand tickets winning five dollars once in one "Game" across and five dollars tripled in one "Game" across to win twenty dollars;

    (q) One thousand tickets winning twenty dollars once in one "Game" across to win twenty dollars;

    (r) Three thousand tickets winning two dollars once and five dollars once in two "Games" across and one dollar tripled in one "Game" across to win ten dollars;

    (s) Three thousand tickets winning five dollars doubled in one "Game" across to win ten dollars;

    (t)One thousand tickets winning one dollar ten times in ten "Games" across to win ten dollars;

    (u) One thousand tickets winning ten dollars once in one "Game" across to win ten dollars;

    (v) Four thousand tickets winning four dollars doubled in one "Game" across to win eight dollars;

    (w)Four thousand tickets winning eight dollars once in one "Game" across to win eight dollars;

    (x) Eight thousand tickets winning one dollar once in one "Game" across and two dollars doubled in one "Game" across to win five dollars;

    (y) Eight thousand tickets winning two dollars once in one "Game" across and one dollar tripled in one "Game" across to win five dollars;

    (z) Four thousand tickets winning one dollar five times in five "Games" across to win five dollars; and

    (aa) Four thousand tickets winning five dollars once in one "Game" across to win five dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number four hundred forty-six shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number four hundred forty-six is sold or deemed sold in accordance with this rule and the covering material over the prize values and play symbols has been removed, the holder shall be deemed to have drawn the prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred forty-six in which the ticket was sold.

    (3) The Top Prize Drawing to award one grand prize of two hundred thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing "Prize drawings" and rule 3770:1-6-01 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prizes which are to be paid by sales agents in accordance with commission rules, as well as procedures for entry in to the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any

    ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred forty-six void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number four hundred forty-six.

    (1) The director shall conduct game rule number four hundred forty-six in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred forty-six. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number four hundred forty-six used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred forty-six and these elements may be given names or titles chosen by the commission.
