    3770:1-9-323               Game rule number three hundred twenty-three.

     

     

     

    (A)      Title and term. Ohio lottery commission game rule number three hundred twenty-three, "Double Lucky 7's," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number three hundred twenty-three.

     

    (B)  General design.

     

    (1)   Game rule number three hundred twenty-three is a number symbol find game and is generally known as an "instant lottery."

     

    (2)    Game rule number three hundred twenty-three contains six separate games, "Game 1" through "Game 6." The player will remove the covering over the play area of each "Game" to reveal three number symbols and one corresponding prize value shown below the three number symbols. Number symbols may include numbers "1" through "16," "18" through "20" and "77." If the player reveals a number "7" symbol in any one "Game," the player wins the corresponding prize value shown for that "Game." If the player reveals a number "77" symbol in any one "Game" (consisting of two sevens side by side) the player wins double the corresponding prize value shown for that "Game." There are six chances to win on each ticket, and a player may win up to six times on one ticket.

     

    (3)     As used in this rule, "prize award" shall mean any one of the following monetary amounts which is the total of all wining prize values on the ticket: two dollars, four dollars, seven dollars, seventeen dollars, forty-seven dollars, seventy-seven dollars, two hundred seventy-seven dollars, five hundred dollars, one thousand dollars and seventeen thousand seven hundred seventy-seven dollars. Each ticket in game rule number three hundred twenty-three shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number three hundred twenty-three shall be two dollars.

     

    (D)  Structure, nature and value of prize awards.

     

     

     

     

    (1)      There shall be one type of prize in game rule number three hundred twenty-three called a "regular prize award."

    (2)    The only "prize values" which shall appear on a ticket in game rule number three hundred twenty-three are: one dollar, two dollars, three dollars, four dollars, five dollars, seven dollars, fourteen dollars, seventeen dollars, forty-seven dollars, seventy-seven dollars, two hundred  seventy-seven dollars, five hundred dollars, one thousand dollars and seventeen thousand seven hundred seventy-seven dollars. Prize values and number symbols shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values and number symbols.

    (a)     Holder of a valid winning ticket on which a number "77" symbol is revealed in one "Game" for one dollar doubled shall win a regular prize award of two dollars;

    (b)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for two dollars once shall win a regular prize award of two dollars;

    (c)     Holder of a valid winning ticket on which a number "7" symbol is revealed in four "Games" for one dollar four times shall win a regular prize award of four dollars;

    (d)    Holder of a valid winning ticket on which a number "77" symbol is revealed in one "Game" for two dollars doubled shall win a regular prize award of four dollars;

    (e)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for four dollars once shall win a regular prize award of four dollars;

    (f)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for one dollar once, and a number "77" symbol is revealed in one "Game" for three dollars doubled shall win a regular prize award of seven dollars;

    (g)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for seven dollars once shall win a regular prize award of seven dollars;

    (h)     Holder of a valid winning ticket on which a number "7" symbol is revealed in all six "Games" for two dollars five times and seven dollars once shall win a regular prize award of seventeen dollars;

    (i)   Holder of a valid winning ticket on which a number "7" symbol is revealed in two "Games" for three dollars once, and a number "77" symbol is revealed in one "Game" for seven dollars doubled shall win a regular prize award of seventeen dollars;

    (j)   Holder of a valid winning ticket on which a number "7" symbol is revealed in four "Games" for one dollar three times and fourteen dollars once shall win a regular prize award of seventeen dollars;

    (k)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for five dollars once, and a number "77" symbol is revealed in two "Games" for two dollars doubled and four dollars doubled shall win a regular prize award of seventeen dollars;

    (l)   Holder of a valid winning ticket on which a number "7" symbol is revealed in five "Games" for one dollar once and four dollars four times shall win a regular prize award of seventeen dollars;

    (m)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for seventeen dollars once shall win a regular prize award of seventeen dollars;

    (n)     Holder of a valid winning ticket on which a number "7" symbol is revealed in four "Games" for five dollars once and fourteen dollars three times shall win a regular prize award of forty-seven dollars;

    (o)     Holder of a valid winning ticket on which a number "7" symbol is revealed in all six "Games" for five dollars once, seven dollars four times and fourteen dollars once shall win a regular prize award of forty-seven dollars;

    (p)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for five dollars once, and a number "77" symbol is revealed in two "Games" for seven dollars doubled and fourteen dollars doubled shall win a regular prize award of forty-seven dollars;

    (q)     Holder of a valid winning ticket on which a number "7" symbol is revealed in four "Games" for two dollars three times and seven dollars once, and a number "77" symbol is revealed in one "Game" for seventeen dollars doubled shall win a regular prize award of forty-seven dollars;

    (r)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for forty-seven dollars once shall win a regular prize award of forty-seven dollars;

    (s)     Holder of a valid winning ticket on which a number "7" symbol is revealed in two "Games" for two dollars once and forty-seven dollars once, and a number "77" symbol is revealed in one "Game" for fourteen dollars doubled shall win a regular prize award of seventy-seven dollars;

    (t)  Holder of a valid winning ticket on which a number "7" symbol is revealed in all six "Games" for two dollars once, seven dollars once and seventeen dollars four times shall win a regular prize award of seventy-seven dollars;

    (u)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for seventy-seven dollars once shall win a regular prize award of seventy-seven dollars;

    (v)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for two hundred seventy-seven dollars once shall win a regular prize award of two hundred seventy-seven dollars;

    (w)    Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for five hundred dollars once shall win a regular prize award of five hundred dollars;

    (x)     Holder of a valid winning ticket on which a number "77" symbol is revealed in one "Game" for five hundred dollars doubled shall win a regular prize award of one thousand dollars;

    (y)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for one thousand dollars once shall win a regular prize award of one thousand dollars; and

    (z)     Holder of a valid winning ticket on which a number "7" symbol is revealed in one "Game" for seventeen thousand seven hundred seventy-seven dollars shall win a regular prize award of seventeen thousand seven hundred seventy-seven dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number three hundred twenty-three will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional or returned tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)    Mathematical reasoning indicates that the number of winning tickets sold per five million two hundred thousand tickets sold should be as follows:

    (a)    Eight tickets winning seventeen thousand seven hundred seventy-seven dollars once to win seventeen thousand seven hundred seventy-seven dollars;

    (b)     Ten tickets winning one thousand dollars once to win one thousand dollars; and

    (c)    Ten tickets winning five hundred dollars doubled to win one thousand dollars.

    (3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, and average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)     Two tickets winning five hundred dollars once to win five hundred dollars;

    (b)   Two tickets winning two hundred seventy-seven dollars once to win two hundred seventy-seven dollars;

    (c)    Forty tickets winning seventy-seven dollars once to win seventy-seven dollars;

    (d)     Fifty-six  tickets  winning  two  dollars  once,  seven  dollars  once  and seventeen dollars four times to win seventy-seven dollars;

    (e)     Fifty  tickets  winning  two  dollars  once,  forty-seven  dollars  once  and fourteen dollars doubled to win seventy-seven dollars;

    (f)   One hundred tickets winning forty-seven dollars once to win forty-seven dollars;

    (g)    One hundred twenty-five tickets winning two dollars three times, seven dollars once and seventeen dollars doubled to win forty-seven dollars;

    (h)     One  hundred  thirty  tickets  winning  five  dollars  once,  seven  dollars doubled and fourteen dollars doubled to win forty-seven dollars;

    (i)    Four hundred tickets winning five dollars once, seven dollars four times and fourteen dollars once to win forty-seven dollars;

    (j)     Two hundred forty-five tickets winning five dollars once and fourteen dollars three times to win forty-seven dollars;

    (k)      Two  hundred  fifty  tickets  winning  seventeen  dollars  once  to  win seventeen dollars;

    (l)    Two hundred fifty tickets winning one dollar once and four dollars four times to in seventeen dollars;

    (m)   One thousand tickets winning five dollars once, two dollars doubled and four dollars doubled to win seventeen dollars;

    (n)    Two hundred fifty tickets winning one dollar three times and fourteen dollars once to win seventeen dollars;

    (o)    One thousand tickets winning one dollar once, three dollars once and seven dollars doubled to win seventeen dollars;

    (p)   Two hundred fifty tickets winning two dollars five times and seven dollars once to win seventeen dollars;

    (q)   Two thousand tickets winning seven dollars once to win seven dollars;

    (r)   Five thousand tickets winning one dollar once and three dollars doubled to win seven dollars;

    (s)   Two thousand tickets winning four dollars once to win four dollars;

    (t)  Seven thousand tickets winning two dollars doubled to win four dollars;

    (u)   Three thousand tickets winning one dollar four times to win four dollars;

    (v)   Nine thousand tickets winning two dollars once to win two dollars; and

    (w)  Ten thousand tickets winning one dollar doubled to win two dollars.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number three hundred twenty-three shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2)   When a ticket issued in game rule number three hundred twenty-three is sold or deemed sold in accordance with this rule and the covering material over the prize values and number symbols has been removed, the holder shall be deemed to have drawn the prize values and number symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number three hundred twenty-three in which the ticket was sold.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. For merchandise prizes, prize winners must comply with the claim and validation procedures set forth on the back of each such winning ticket. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number three hundred twenty-three void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number three hundred twenty-three.

    (1)    The director shall conduct game rule number three hundred twenty-three in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number three hundred twenty-three. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)      Names and definitions of elements of game rule number three hundred twenty-three used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number three hundred twenty-three and these elements may be given names or titles chosen by the commission.
