    OHIO RESPIRATORY CARE BOARD

     

    NOTICE OF PUBLIC HEARING OF INTENT TO AMEND OR RESCIND OHIO ADMINISTRATIVE RULES

     

    The Ohio Respiratory Care Board announces its intent to amend Rules 4761-1-01(Public Hearing); 4761-1-02(Notice of Meetings); 4761-2-01(Board Organization); 4761-2-03(Board Records); 4761-4-01(Approval of Educational Programs); 4761-4-02(Surveys); 4761-5- 01(Examinations); 4761-5-02(Admissions to Exam); 4761-5-04(Application Procedures); 4761- 5-05(Nonresident Practice); 4761-5-06(Practice by Polysomnographic Technologists); 4761-6- 01(Limited Permit application procedures); 4761-7-03(Scope of Care); 4761-7-04(Supervision); 4761-8-01 (Renewal); 4761-8-02(Licenses Not in Active Practice); 4761-9-02(RCCE Requirements); 4761-9-03(Activities that do not meet RCCE Requirements); 4761-9-04(RCCE Requirements by License Type); 4761-9-05(Approval RCCE Activity); 4761-9-07(Auditing); 4761-10-01(Ethics); 4761-11-02(Administrative Procedures); 4761-11-14(Reports and Recommendations); and 4761-12-01(Fees). The board also intends to adopt new rules 4761-12- 02(Renewal Fees).

     

    The following represents a summary of the proposed amendments:

     

             : Removes publication of rules hearing notice in regional newsprint. Requires posting on the register of Ohio website.

     

             : removes requirement to file self-addressed envelopes for meeting notification. Provides for notification by mail or electronic mail.

     

    4761-2-01: corrects grammatical errors and adds election of hearing officer.

     

    4761-2-03: clarifies that register of applicants will be electronic and contents of paper files. 4761-4-01: corrects grammatical errors.

    4761-4-02: removes original survey requirements and adds annual reporting requirements of Ohio respiratory care educational programs. Also forms a standing committee of the board to review reports.

     

             : removes continuing education requirements for non-resident applicants and corrects title of examinations.

     

                                      : corrects title of Ohio examination.

     

     

     

     

     

     

     

     

             : removes unnecessary language relating to abandon files and waiver of educational qualifications.

    : corrects grammatical errors.

    : stipulates that a registered polysomnographic technologists is defined.

    4761-6-01: clarifies discontinuance in a respiratory care educational program and removes unnecessary language from abandoned file provision.

             : amends definition of "administering of medical gases" and adds a definition of "aspiration."

             : adds language concerning the supervision of student limited permit holders and limitations of practice.

             : clarifies when payment of late renewal fee is due and waiver of renewal fee for initial applicants. Also changes lapsed and inactive time requirements for continuing education.

             : deletes language and references new language in rule 4761-8-01.

             : clarifies when new continuing education collection can begin for next renewal period.

             : removes two continuing education programs previously not recognized. 4761-9-04: clarifies recognition of continuing education programs.

    4761-9-05: clarifies recognition of professional examinations as meeting continuing education requirements.

    4761-9-07: removes a reporting requirement for continuing education audits.

    4761-10-01: clarifies adherence to professional standards and guidelines, cooperating with other health professionals, carrying out a prescribed service, engaging in fraudulent charting or fraudulent billing as a ethical requirement.

    4761-11-02: revises paragraph outline. 4761-11-14: revises paragraph outline. 4761-12-01: revises initial application fees.

             : establishes license and limited permit renewal fees.

             : changes cost for replacement of certificates and identification cards.

    A public hearing will be held at 1:00 p.m., Thurs., May 29, 2003 in room 1918 of the Vern Riffe Center for Government, 77 South High St., Columbus, Ohio. At the public hearing, persons affected by the proposed rule revisions may appear and be heard in person, or by an attorney, or may submit written or oral testimony, examine witnesses and present evidence to show that the proposed rule, if adopted, will be unreasonable, or unlawful.
