    NOTICE OF PUBLIC HEARING

    A public hearing will be held by the Ohio Department of Agriculture on May 31, 2016 at 10 a.m., in Room 133, in the Bromfield Administration Building, located at 8995 East Main Street, Reynoldsburg, Ohio 43068. The purpose of the hearing is to solicit public comment on the following proposed rules:

     

    901:6-2-01 titled "National Type Evaluation Standard" is being amended in order to add commercial weighing and measuring devices required to have a certificate of conformance.

    901:6-3-01 titled "Application" is being amended in order to make minor stylistic changes. However the rule remains substantively the same.

    901:6-3-02 titled "Definitions" is being amended in order to define the term "person."

    901:6-3-03 titled "Declaration of Identity: Consumer Package" is being amended in order to include the identity statement exemption set forth in the Fair Packaging and Labeling Act for food packages, other than meat or poultry, that are repackaged in retail establishments and displayed in certain circumstances.

    901:6-3-04 titled "Declaration of Identity: Non-Consumer Packages" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-3-05 titled "Declaration of Responsibility: Consumer and Nonconsumer Packages" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-3-06 titled "Declaration of Quantity: Consumer Packages" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-3-07 titled "Declaration of Quantity" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-3-08 titled "Prominence and Placement: Consumer Packages" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-3-09 titled "Prominence and Placement: Nonconsumer Packages" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-3-10 titled "Requirements: Specific Consumer Commodities, Packages, Containers" is  being  amended  to  incorporate  changes  made  to  the  National  Institute  of  Standards

     

     

     

     

     

     

     

    Technology (NIST) Handbook 130 (2016). The amendments include packages using bag- on-valve technology and indirect sale of random packages.

    901:6-3-11 titled "Exemptions" is being amended to incorporate an exemption adopted in NIST Handbook 130 (2016), specifically the exemption of SI units for United Sates customary units.

    901:6-3-12 titled "Variations to be Allowed" is being amended in order to make minor stylistic changes. However, the rule remains substantively the same.

    901:6-7-01 titled "Definitions" is a new rule that establishes the definitions used in Chapter 9:6-7 of the Administrative Code.

    901:6-7-02 titled "Food Products" is being amended in order to add food products such as bread, flour, and pelletized ice cream. This rule is also being amended in order to include specific information that must be provided by the seller at the time of sale and time of delivery of food products.

    901:6-7-03 titled "Non-Food Products" is being amended to add some non-food products, including but not limited to, stove wood pellets, liquid oxygen used for respiration, animal bedding, wiping cloths, and potpourri.

    901:6-7-04 titled "General" is being amended to make stylistic changes. However, the rule remains substantively the same.

    All interested parties are invited to attend the hearing and present oral and/or written testimony. Written comments may also be submitted to the attention of Hannah Smith-Carr, Senior Staff Counsel, Ohio Department of Agriculture, 8995 East Main Street, Reynoldsburg, Ohio 43068, or via email at ecomments@agri.ohio.gov, or via transmitting by facsimile at (614) 995-4585. Written comments sent by mail shall be postmarked no later than the day of the hearing. Written comments transmitted by facsimile shall be received no later than 5:00 p.m. on the day of the hearing.
