    RULE SUMMARY

    1.  Is the rule being filed consistent with the requirements of the RC 119.032 review? Yes

    2.  Are you proposing this rule as a result of recent legislation? No

    3.  Statute prescribing the procedure in accordance with the agency is required to adopt the rule: 119.03

    4.  Statute(s) authorizing agency to adopt the rule: 1531.06, 1531.08, 1531.10

    5.  Statute(s) the rule, as filed, amplifies or implements: 1531.06, 1531.08, 1531.10

    6.  State the reason(s) for proposing (i.e., why are you filing,) this rule:

This rule defines the dates, times, species, bag limits, and methods for hunting wild turkey. Amendments were made to define changes in the hours, dates, and areas turkeys may be hunted.

    7.  If the rule is an AMENDMENT, then summarize the changes and the content of the proposed rule; If the rule type is RESCISSION, NEW or NO CHANGE, then summarize the content of the rule:

Added Williams and Defiance counties to the list of those counties open for fall

turkey hunting. The 2008 expansion of the fall turkey season resulted in a minimal impact on the population with an overall harvest rate of 1.1%. Spring harvest in Williams and Defiance counties indicates the population is sufficient to support a fall harvest.

Expand to all day hunting during the last two weeks of spring turkey season. "All day" would be defined as 1/2 hour before sunrise to sunset. After an extensive analysis of the spring turkey seasons, our biologists felt that expanding hunting hours the last 2 weeks (May 3- May16) of the season would have negligible impact on harvest while expanding opportunity. The required time for hunters to check-in turkeys during the last two weeks of the season will be extended to 2:00 pm the following day of the harvest.

The dates for fall turkey season was amended to the second Saturday of October to the last Sunday of November.

The dates for the spring turkey season was amended to be open from April 19, 2010 to May 16, 2010.

The dates for youth turkey season was amended to be open April 17 and 18, 2010.

    8.  If the rule incorporates a text or other material by reference and the agency claims the incorporation by reference is exempt from compliance with sections

121.71 to 121.74 of the Revised Code because the text or other material is generally available to persons who reasonably can be expected to be affected by the rule, provide an explanation of how the text or other material is generally available to those persons:

This response left blank because filer specified online that the rule does not incorporate a text or other material by reference.

    9.  If the rule incorporates a text or other material by reference, and it was infeasible for the agency to file the text or other material electronically, provide an explanation of why filing the text or other material electronically was infeasible:

This response left blank because filer specified online that the rule does not incorporate a text or other material by reference.

    10.  If the rule is being rescinded and incorporates a text or other material by reference, and it was infeasible for the agency to file the text or other material, provide an explanation of why filing the text or other material was infeasible:

    Not Applicable.

    11.  If revising or refiling this rule, identify changes made from the previously filed version of this rule; if none, please state so:

March 30,2009 - The rule was further amended allowing hunters who harvest a turkey during the last two weeks of the season, with the extended hunting hours, to be required to check-in their turkeys by 2:00 pm the following day of the harvest. Currently the law requires hunters to check-in their turkeys by 2:00 p.m. the day of the harvest.
