State Board of Sanitarian Registration Notice of Public Hearing

 

The State Board of Sanitarian Registration has authorized a public hearing based on its intention to amend existing rules, 4736-1-01, 4736-7-01, 4736-7-02, 4736-8-01, 4736-9-03, 4736-10-01, 4736-11-03, 4736-11-

04, 4736-11-05, 4736-11-09, 4736-12-01, 4736-13-01, and to adopt new rule 4736-11-08 and rescind existing rule 4736-11-08 of the Ohio Administrative Code.

 

In accordance with Sections 119.03 and 4736.03 of the Ohio Revised Code, and Rule 4736-3-04 of the Ohio Administrative Code adopted by the State Board of Sanitarian Registration under Section 119.03 of the Revised Code, the State Board of Sanitarian Registration will hold a public hearing on the above referenced rules at 10:30 a.m., Thursday, June 3, 2004 in the Main Boardroom at 77 South High Street, 31st Floor, Columbus, Ohio.

 

The purpose of Proposed Amended Rules 4736-1-01 entitled, "Definitions" and 4736-8-01, entitled, "Requirements for Registration" is to update the rules with gender-neutral references.

 

The purpose of Proposed Amended Rules 4736-7-01 entitled, "Application Form" and 4736-11-05 entitled, "Registration and Approval of Training Agency" is to delete language that is no longer applicable.

 

The purpose of Proposed Amended Rules 4736-7-02 entitled, "Application Fee" and 4736-12-01, entitled, "Annual Renewal" is to provide the most accurate information regarding current application and renewal fees.

 

The purpose of Proposed Amended Rule 4736-9-03 entitled, "Passing Score" is to provide a concise definition of the passing score on the registration examination.

 

The purpose of Proposed Amended Rule 4736-10-01 entitled, "Sanitarian-in-training Extension Request" is to provide that the Board may require sanitarians-in-training who have failed the registration examination three or more times to submit a study plan toward passing the examination.

 

The purpose of Proposed Amended Rule 4736-11-03 entitled, "Hours of Continuing Education Required" is to provide a concise definition of continuing education waiver eligibility.

 

The purpose of Proposed Amended Rule 4736-11-04 entitled, "Types of Continuing Education Courses" is to include bioterrorism as an approved subject area for continuing education.

 

The purpose of rescinding existing rule 4736-11-08 and adopting proposed new rule 4736-11-08 entitled, "List of Approved Courses" is to delete language that is no longer applicable and to update the rule with the Board's current website address.

 

The purpose of Proposed Amended Rule 4736-11-09 entitled, "Reinstatement" is to provide further clarification regarding eligibility for registered sanitarian or sanitarian-in-training reinstatement and the requirements one must fulfill to be reinstated.

 

The purpose of Proposed Amended Rule 4736-13-01 entitled, "Revocation" is to update the definition of unprofessional conduct and provide that complaints be submitted within a reasonable time frame.

 

Any person affected by the amendments may appear and be heard in person, by his/her attorney, or both; may present his/her arguments, or contentions, orally, or in writing; offer and examine witnesses; and present evidence tending to show that the amendments, if effectuated, will be unreasonable or unlawful.
