    TO BE RESCINDED

     

    1501:47-7-11               Regulations  prescribed  for  the  use  of  watercraft  on  waters within Summit county.

     

     

     

    (A)  Unauthorized use of dock.

     

    No person shall anchor, moor, dock or tie up any watercraft to any private dock facility, without the consent of the owner or person authorized to give consent, except when an actual emergency exists to prevent obtaining such permission or consent.

     

    (B)  Consuming alcohol in speed or ski boat.

     

    (1)   No person shall consume any beer or intoxicating liquor in a watercraft that is engaged in pulling any person upon skis, aquaplane or other similar device or any barefoot skier.

     

    (2)   No person shall consume any beer or intoxicating liquor in a watercraft that is exceeding the ten or six miles per hour speed limit, whichever is applicable.

     

    (C)  Open container in speed or ski boat.

     

    No person shall possess an open container of beer or intoxicating liquor while in a watercraft that is engaged in pulling any person upon skis, aquaplane or other similar device or any barefoot skier, unless such alcoholic beverage is within a locked compartment of such watercraft for purposes of storage or transportation.

     

    (D)  Horsepower limitations: canoes.

     

    (1)     No person shall operate (start/run) or permit to be operated a motor, or combination of motors, exceeding a horsepower rating in excess of four hundred horsepower to propel a vessel on or within the Portage lakes.

     

    (2)     No person shall operate (start/run) or permit to be operated a motor, or combination of motors, exceeding a horsepower rating in excess of one hundred twenty-five horsepower, to propel a vessel on or within the waters of the county, except where allowed by regulation of the proper park authority or ordinance of a municipality having jurisdiction over such waters.

     

    (3)     No person shall operate (start/run) or permit to be operated a motor, or combination of motors, exceeding a horsepower rating in excess of four horsepower to propel a canoe on or within the waters of the county.

     

     

     

    (4)   Nothing in this rule shall prohibit vessels with higher horsepower motors from being present on these waters provided they comply with paragraphs (D)(1), (D)(2), and (D)(3) of this rule.
