    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to sections 2151.412, 2151.421, 5103.03, 5153.16 and Chapter 119. of the Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon.

     

    OAC 5101:2-38-01 Requirements for PCSA case plan for in-home supportive services without court order sets forth the requirements that apply to the public children services agency (PCSA) for completing an in-home voluntary case plan. This rule is being amended to add language regarding the documentation of contacts.

     

    OAC 5101:2-38-05 PCSA Case plan for children in custody or under court ordered protective supervision sets forth the requirements that apply to the PCSA case plans for children in custody or under protective supervision. This rule is being amended to:

    ·         Reference the foster caregiver.

    ·         Identify parties to the case plan.

    ·         Invite youth ages 14 and older to participate in the case planning and the youth may elect to include two individuals for support.

    ·         Clarify language and revise dates of CAPMIS tools.

     

    OAC 5101:2-38-09 PCSA requirements for completing the case review sets forth the requirements that apply to the PCSA for completing the case review. This rule is being amended to provide consistency and clarity in language, correct paragraph references within the rule, and the revision dates of CAPMIS tools.

     

    OAC 5101:2-38-10 Requirements for completing the semiannual administrative review sets forth the requirements that applies to a PCSA completing the semiannual administrative review (SAR). This rule is being amended to:

    ·         Remove the PCPA requirements for completing the SAR that can be found in rule 5101:2-38-04.

    ·         Expand the list of individuals invited to the SAR per Federal requirement.

    ·         Identify parties to the SAR.

     

    Copies of the proposed rules are available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at  http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony

     

     

    will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
