    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

     

     

    DATE:              May 13, 2010

    TIME:               10:00 a.m.

    LOCATION:     Room 3110B, Rhodes State Office Tower 30 East Broad St., Columbus, Ohio 43215

     

     

    Pursuant to Chapters 5104. and 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon. These rules are being proposed for amendment to comply with statutory changes.

     

    Rule 5101:2-14-02 entitled "Application for professional certification as a type B home provider or in-home aide" has been amended to: add the requirement for providers to complete and submit provider agreement forms to ODJFS in order to be paid for publicly funded child care services; to add language allowing the provider a right to access, review and make copies of information in the county agency files; to add language that the provider can be accompanied by a union representative; to change the revision date of a form; and to change the title.

     

    Rule 5101:2-14-03 entitled "Professional certification compliance inspection of type B home providers and in-home aides" has been amended to add the requirements that a copy of the inspection report be given to the provider before the county staff leaves the provider's home or sent to the provider following a phone investigation; to change the revision date of a form; and to change the title.

     

    Rule 5101:2-14-03.1 entitled "Complaint investigation of professional and limited type B home providers and in-home aides" has been amended to add requirements for providers to receive copies of the investigation report at the time of the investigation visit, when the report is revised and when the report is completed by phone; and to require the county to provide a copy of the investigation report to anyone who requests it.

     

    Rule 5101:2-14-13 entitled "Professional certification compliance inspection of type B home providers and in-home aides" has been amended to add the requirement that a representative of AFSCME Ohio Council 8 be allowed to schedule time before or after a training session in order to present union information to providers; and to clarify language.

     

    Rule 5101:2-14-40 entitled "Appeal review procedures for limited and professional and limited certification as a type B home provider or in-home aide" has been amended to change the title; to clarify language; and to allow AFSCME Ohio Council 8 representatives to act as legal representatives for providers.

     

    A copy of the proposed rules is available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at  http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice.  Either written or oral

     

     

     

     

     

    testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
