5101:2-48-16 Adoption preplacement and placement procedures.

    LEGAL NOTICE STATE OF OHIO

    DEPARTMENT OF JOB AND FAMILY SERVICES

     

    Pursuant  to  sections  2151.86,  3107.013,  3107.031,  3107.032,  3107.062,  3107.083,

    3107.09, 3107.091, 3107.12, 3107.17, 3107.31, 3107.61, 5101.03, 5101.15, 5101.16,

    5101.24,  5103.03,  5103.12,  5103.15,  5103.161,  5153.16,  5153.161,  5153.163  and

    Chapter 119 of the Ohio Revised Code, the director of the Department of Job and Family Services gives notice of the department=s intent to consider the amendment, adoption and rescission of rules governing children services, as identified below and of a public hearing thereon.

     

    The following rules are being proposed for rescission due to the five year rule review:

     

    Rule 5101:2-48-08 entitled Adoption inquiry, identifies information agencies must send to adoption inquiry applicants and requires agencies to log all foster and adoptive parent inquiries.

     

    Rule 5101:2-48-15 entitled Provision of Information to Adoptive Family, stipulates information disclosure requirements.

     

    Rule 5101:2-48-21 entitled Child Study Inventory, identifies information to be included in the CSI based upon SB 27 mandates.

     

    The following rules are to be adopted:

     

    Rule 5101:2-48-08 entitled Adoption inquiry, identifies information agencies must send to adoption inquiry applicants and requires agencies to log all foster and adoptive parent inquiries.  This rule is being proposed to replace current rule 5101:2-48-08.

     

    Rule 5101:2-48-15 entitled Provision of Information to Adoptive Family, stipulates information disclosure requirements. This rule is being proposed to replace current rule 5101:2-48-15.

     

    Rule 5101:2-48-21 entitled Child Study Inventory, identifies information to be included in the CSI based upon SB 27 mandates. This rule is being proposed to replace current rule 5101:2-48-15.

     

    The following rules are being proposed for amendment due to five year rule review requirements:

     

    Rule 5101:2-48-02 entitled Putative father registry, emphasizes that fathers who are not named on the birth certificate and have not registered with the Putative Father Registry within 30 days are not required by law to consent to adoption.

     

    Rule  5101:2-48-03  entitled  Requirements  of  JFS  1616  Social  and  Medical  History,

     

     

     

     

     

     

    requires the PSCA, PCPA, or PNA obtain all information necessary to complete the JFS 01616 Social and Medical History, prior to termination of parental rights.

    Rule 5101:2-48-05 entitled Agency adoption policy and agency recruitment plan, specifies the criteria for matching adoptive parents to available children; requires the incorporation of a "MEPA Bi-Annual Comprehensive Self- Assessment Report" by each PCA, PCSA and PNA.

    Rule 5101:2-48-06 entitled Agency adoption staffing, permits Assessor Training to count if it was taken within two years prior to employment. Also permits, under certain circumstances, a one year extension if Tier 2 was not taken within three years of the completion of Tier 1.

    Rule 5101:2-48-07 entitled Listing and withdrawing children and families with the Ohio Adoption Photo Listing (OAPL) and the AdoptOhio Photo Listing web page, adds a special status category for children who have an adoptive family identified and the family has submitted an application for child placement.

    Rule 5101:2-48-09 entitled Application process and preservice training, outlines the adoption application process including training classes required.

    Rule 5101:2-48-10 entitled Restrictions concerning provisions of adoption service, outlines the BCII criminal records check process.

    Rule 5101:2-48-11 entitled Approval of a foster home for adoptive placement, clarifies the adoption procedures for foster caregivers not approved through the joint home study process.

    Rule 5101:2-48-11.1 entitled Foster caregiver adoption of a foster child who has resided with the caregiver for at least twelve months, stipulates that the child must be in the home for twelve consecutive months.

    Rule 5101:2-48-12 entitled Completion of the home study report, removes grandparents from the category of persons exempt from using the JFS 01673 and  rewords  the inclusion of JFS 01348 Safety Audit of a Foster Home.

    Rule 5101:2-48-13 entitled Adoption requirements pursuant to the Multiethnic Placement Act, requires agencies to utilize of the JFS 01689 Documentation of the Placement Decision-Making Process and MEPA Bi-Annual Comprehensive Self-Assessment Report.

    Rule 5101:2-48-14 entitled Preparation of Child for Adoptive Placement, outlines process agencies must follow in preparing children for adoptive placement.

    Rule 5101:2-48-16 entitled Adoptive Placement Procedures, stipulates preferential order to be given when considering a child for adoptive placement and requires the PCSA or

    PCPA to provide the prospective adoptive parent with the child study inventory (CSI) prior to the date of adoptive placement.

    Rule 5101:2-48-17 entitled Prefinalization Services, stipulates services required to be provided to family and child prior to finalization.

    Rule 5101:2-48-20 entitled Release of identifying and nonidentifying information, outlines information that may be released to family

    Rule 5101:2-48-22 entitled Adoptive family case record, identifies information that must be contained in the adoptive family case record.

    Rule 5101:2-48-23 entitled Preservation of adoptive child case record, stipulates information that must be contained in the child's adoptive case record.

    Rule 5101:2-48-24 entitled Agency adoption review procedures, was amended to specify that documentation related to the agency's review must be maintained in the child's and family's record.

    A public hearing on the proposed rule will be held on June 3, 2003 at 9:30 a.m. until all testimony is heard in the Room 1823 in the Rhodes State Office Tower, 30 East Broad Street, Columbus, Ohio. Either written or verbal testimony on the proposed rule will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than June 3, 2003 will be treated as testimony.
