    Revisions to existing rule 5123:2-9-34 are necessary to reflect changes being made to the Level One Waiver benefit package. The Department is taking this opportunity to create distinct rules for the Residential Respite and Community

    Respite services in accordance with our newer model for rules. The provisions of existing rule 5123:2-9-34 related to Residential Respite are being replaced by new rule 5123:2-9-34. The provisions of existing rule 5123:2-9-34 related to Community Respite are being replaced by new rule 5123:2-9-22.

    The rule defines Residential Respite and sets forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service.

    Paragraph (C)(1) sets forth that a provider of Residential Respite must be licensed or certified by the Department and have a Medicaid provider agreement with the Ohio Department of Medicaid.

    Paragraph (C)(2) requires a provider of Residential Respite to complete and submit an application and adhere to the requirements of either rule 5123:2-2-01 (Provider Certification) or 5123:2-3-19 (Licensed Providers of Waiver Services) of the Administrative Code.

    B.) Does this rule impose a criminal penalty, a civil penalty, or another sanction, or create a cause of action, for failure to comply with its terms? Yes

    Paragraph (C)(3) sets forth that failure of a certified provider to comply with this rule and rule 5123:2-2-01 of the Administrative Code may result in denial, suspension, or revocation of the provider's certification.

    Paragraph (C)(4) sets forth that failure of a licensed provider to comply with this rule and Chapter 5123:2-3 of the Administrative Code may result in denial, suspension, or revocation of the provider's licensure.
