NOTIFICATION OF PUBLIC HEARING

Notice of hearing to amend Rules 4501:1-1-01, -02, -03, -04, -05, -07, -08, -09, -10, -11, -

15, -16, -17, -18, -19, -20, -22, -23, -24, -25, -26, -28, -29, -30, -34, -35, and -37,

and to adopt new Rule 4501:1-1-39

of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code

 

Notice is hereby given that a hearing will be held by the Registrar of the Bureau of Motor Vehicles division of the Ohio Department of Public Safety for the purpose of considering adoption of the above-listed proposed administrative rules.

 

Based on a review of Chapter 4501:1-1 of the Ohio Administrative Code and as authorized in Sections 4501.02, 4506.09, 4506.17, 4506.22, 4507.01, 4507.09, and

4507.12 of the Ohio Revised Code, the Registrar of the Bureau of Motor Vehicles has proposed to amend Rules 4501:1-1-01, -02, -03, -04, -05, -07, -08, -09, -10, -11, -15, -16,

-17, -18, -19, -20, -22, -23, -24, -25, -26, -28, -29, -30, -34, -35, and -37, and to adopt

new Rule 4501:1-1-39 of the Ohio Administrative Code regarding operator licenses and identification cards for the purposes of updating, enhancing, correcting, and clarifying the rules.

 

Proposed changes include spelling corrections, gender-neutral language changes, clarifying the revised date of incorporated federal regulations, clarifying rule language by providing missing and replacing inconsistent language, correctly reflecting actual standards for commercial driver's license applicants (other than school bus driver's license applicants) who are not required to meet the standards of 49 C.F.R. 391 by changing the lower limit for visual acuity that allows for issuance of a restricted license from (from 20/60 to 20/70) and changing the lower limit for visual acuity beyond which results in denial of a license (from 20/60 to 20/70), removing reference to the "American Optometric Association," the "American Association of Motor Vehicle Administrators," and the "American Medical Association" and further revising the definition of "visual

acuity," updating the rule listings of authorizing and implementing statutes, and providing website and address information for use in obtaining federal regulations incorporated within the rules of Administrative Code Chapter 4501:1-1.

 

A public hearing on the proposed rules will be held Thursday, June 28, 2007 at 10:00

a.m. in room 109 (first floor) of the Charles D. Shipley Building, Ohio Department of Public Safety, 1970 West Broad Street, Columbus, Ohio.

 

Either written or oral testimony will be received at the hearing. Additionally, written comments received at the address below before the hearing will be treated as testimony.
