    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES DATE:  June 1, 2016

    TIME:  10:00 AM

    LOCATION: Room 3110B, Rhodes State Office Tower 30 East Broad Street, Columbus, Ohio 43215

     

    Pursuant to sections 3125.25 and 5101.35 and Chapter 119. of the Ohio Revised Code, the direct of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the adoption, amendment, or rescission of the rule or rules as identified below and of a public hearing thereon. The rules, herein, previously were a part of a public hearing dated May 23, 2016.  However, changes to the rules resulting from stakeholder feedback necessitates a second public hearing.

     

    Rule 5101:6-2-04, entitled, "State hearings: prior notice of adverse action" is being proposed for amendment to clarify policy relating to electronically distributing notices of adverse action, as permitted by federal or state law. This rule sets forth the requirements for local agencies to following when issuing a notice of adverse action. The change to this rule clarifies policy relating to electronically distributing notices of adverse action, as permitted by federal or state law.

     

    Rule 5101:6-8-01, entitled, "State hearings: administrative appeal of the state hearing decision" is being proposed for amendment to update policy to allow electronic requests for administrative appeals. This rule sets forth the rights and requirements for requesting an administrative appeal. The changes to this rule include offering the option of requesting an administrative appeal electronically and removing a reference to a form that is internal to the Hearings and Appeals Tracking System.

     

    Rule 5101:6-10-01, entitled, "State hearings: hearings for the comprehensive case management and employment program" is being proposed for adoption to implement provisions of Sec.

    305.190 of Amended Substitute House Bill 64, of the 131st General Assembly, that was signed into law requiring the administration of the comprehensive case management and employment program. This new rule outlines the procedures for program participants requesting a hearing and the responsibilities of the lead agency in fulfilling its obligations throughout the hearing process.

     

    A copy of the proposed rules is available, without charge, to any person affected by the rule at the address listed below. The rules are also available on the internet at http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
