TO BE RESCINDED
3745-27-02 Applicability and relation to other chapters and laws.
(A) Applicability. This chapter applies to all of the following:
(1) Sanitary landfill facilities (rules 3745-27-06 to 3745-27-20 and rule 3745-27-97 of the Administrative Code);
(2) Solid waste transfer facilities (rules 3745-27-21 to 3745-37-24 of the Administrative Code);
(3) Infectious waste generators, transporters, and treatment facilities (rules 3745-27-30 to 3745-27-37 of the Administrative Code);
(4) Solid waste composting facilities (rules 3745-27-40 to 3745-27-47 of Administrative Code);
(5) Solid waste incinerator facilities (rules 3745-27-50 to 3745-27-53 of the Administrative Code);
(6) Solid waste management districts (rule 3745-27-90 of the Administrative Code);
(7) Plastic container labeling (rule 3745-27-91 of the Administrative Code);
(8) Scrap tire collection, storage, and recovery facilities (rules 3745-27-57, 3745-27-60 to 3745-27-67 and 3745-27-97 of the Administrative Code);
(9) Scrap tire transporters (rules 3745-27-54 to 3745-27-57 of the Administrative Code);
(10) Scrap tire monofill and monocell facilities (rules 3745-27-69 to 3745-27-79 and 3745-27-97 of the Administrative Code);
(11) Scrap tire generators, exempt scrap tire facilities, and exempt scrap tire transporters (rules 3745-27-57 and 3745-27-60 of the Administrative Code);
(B) Relation to other chapters.
(1) Industrial solid waste landfill facilities are a type of sanitary landfill facility subject to the requirements of Chapters 3745-29, 3745-31, and 3745-37 of the
Administrative Code and rule 3745-27-97 of the Administrative Code.
(2) Residual waste landfill facilities are a type of sanitary landfill facility subject to the requirements of Chapters 3745-30, 3745-31, and 3745-37 of the Administrative Code and rule 3745-27-97 of the Administrative Code.
(3) General solid waste facility permitting requirements, including the definition of a "modification," are in Chapter 3745-31 of the Administrative Code.
(4) Licensing requirements for solid waste facilities, including scrap tire facilities, are in Chapter 3745-37 of the Administrative Code.
(C) Relation to other laws. No provision of Chapters 3745-27 and 3745-37 of the Administrative Code shall exempt any person from compliance with any section of the Ohio Revised Code, or any regulation of any federal agency, or of any department of the state government, including the Ohio department of health and the Ohio department of natural resources.
