    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

     

    DATE:           Monday, July 7, 2008

    Pursuant to section 5104 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment and rescission of the rules identified below as a result of Sub. SB 163 of the 127th General Assembly.

     

    Rule 5101:2-12-09 Denial or Revocation of a Child Care Center Application or License is being amended to include sections of the Revised Code that list additional prohibited criminal offenses. The title of this rule has also been amended to better reflect the content.

     

    Rule 5101:2-12-26 Statement of Non-Conviction and Criminal Records Check for Licensed Child Care Center Staff is being rescinded and replaced with a new rule of the same number that provides new requirements for BCII criminal background checks.

     

    Rule 5101:2-13-04 Application and Issuance of Initial License for a Type A Home is being amended to add a provision that a type A provider cannot be certified as a foster home or a specialized foster home.

     

    Rule 5101:2-13-09  Denial or Revocation of a Type A Home Application or License is being amended to include sections of the Revised Code that list additional prohibited criminal offenses.  The title of this rule has also been amended to better reflect the content.

     

    Rule 5101:2-13-26 Statement of Non-Conviction and Criminal Records Check for Licensed Type A Homes is being amended to provide new requirements for BCII and FBI criminal background checks and to reference the new JFS 01328 "Statement of Nonconviction for Child Care Centers and Type A Homes."

     

    A copy of the proposed rules is available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Both written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
