    LEGAL NOTICE STATE OF OHIO

    DEPARTMENT OF NATURAL RESOURCES NOTICE OF INTENTION TO ADOPT

    AND TO HOLD A PUBLIC HEARING ON THE DIVISION OF FORESTRY'S SILVICULTURAL ASSISTNACE PROGRAM RULES

     

    The Chief for the Division of Forestry pursuant to Chapter 119. and sections 1503.01 and

    1503.51 of the of the Revised Code, hereby gives notice of his intention to adopt the following Silvicultural Assistance Program rules:

     

    1501:3-12-01  General provisions;

    1501:3-12-02  Erosion from silvicultural operations;

    1501:3-12-03  Agricultural pollution abatement cost sharing; 1501:3-12-04  Administrative procedures;

    1501:3-12-05  Operating procedures; and 1501:3-12-06  Chief's orders.

     

    The reasons for adopting these rules are the following: to comply with the Amended Substitute House Bill No. 64 of the 131st General Assembly. A highlight of the bill was the transfer of the Silvicultural Assistance Program from the Ohio Department of Natural Resources (ODNR) Division of Soil and Water Resources to the ODNR Division of Forestry. These rules are being adopted pursuant to that transfer.

     

    A public hearing on the proposed new rules will be held at 10:00 AM on Monday, June 6, 2016 in the E-1 Assembly Center of the Ohio Department of Natural Resources, 2045 Morse Road, Building E-1, Columbus, Ohio 43229. At the public hearing, any person affected by the proposed new rules may appear and be heard in person, or by the person's attorney, or both, and may present the person's positions, arguments, or contentions, orally or in writing, offer and examine witnesses, and present evidence tending to show that the proposed new rules, if adopted, will be unreasonable or unlawful.

     

    Written positions, arguments, or contentions regarding these proposed new rules may also be submitted to the Division of Forestry at the address below or to the following e- mail address: forestry.comments@dnr.state.oh.us. Such written positions, arguments, or contentions must be post-marked or e-mailed by June 13, 2016.

     

    Copies of the proposed new rules are available on the Register of Ohio website,  http://www.registerofohio.state.oh.us/index.jsp. Copies will also be posted on the Ohio Department of Natural Resources Division of Forestry website,  http://forestry.ohiodnr.gov/proposedrulechanges.
