    NOTICE OF PUBLIC HEARING

     

    The Ohio Bureau of Workers' Compensation will hold a public hearing on Wednesday, July 24, 2013, at 3:00 p.m., in Room 1, Level 2, 30 West Spring Street, Columbus, Ohio 43215, to consider the following:

     

    R.C. 119.032 requires BWC to conduct a five-year rule review for each of its rules subject to the R.C. Chapter 119 rulemaking process. These rules govern  the administrative process for obtaining and maintaining coverage, ratemaking, and BWC's rating and discount programs.

     

    Amending the following rules for the purposes as shown below:

     

    4123-17-14   Rule controlling the completing of payroll reports.

     

    Updates the requirement that BWC issue payroll reports to public employer taxing districts in January of each year (as opposed to by January 1).

     

    4123-17-14.1 Misrepresentation of payroll.

     

    Replaces penalties specified for first and second offense for violation of rule with criteria for determining appropriate penalty based on circumstances of the violation.

     

    4123-17-16  Premium security deposit.

     

    Clarifies that review of the level of employers' security deposit will occur on at least an annual basis.

     

      Protest of an employer's experience.

     

    Updates reference to fax or e-mail to be included in "written means."

     

      rrection of inaccuracies affecting employer's premium rates.

     

    Clarifies references to rating years to which corrections apply.

     

    Rescinding the following rules for the purposes as shown below:

     

    4123-17-03.1 Experience modification for out of state employer.

     

    The introduction of Grow Ohio eliminates the need for this rule. An employer moving operations to Ohio may enter a group immediately or enjoy a 25% discount on premiums.

     

    4123-17-07  Officers of corporations, partnerships and sole proprietorships, an individual incorporated as a corporation with no employees, family farm corporations, and ordained ministers.

     

     

     

     

     

     

     

    Updates the definition of "minister" and "church" to be more inclusive, consistent with other definitions found in the Revised Code (recommendation is to rescind and replace due to Legislative Service Commission requirements).

    Enacting the following rule for the purposes as shown below:

    4123-17-07  Officers of corporations, partnerships and sole proprietorships, an individual incorporated as a corporation with no employees, family farm corporations, and ordained ministers.

    Updates the definition of "minister" and "church" to be more inclusive, consistent with other definitions found in the Ohio Revised Code (recommendation is to rescind and replace due to Legislative Service Commission requirements).

    All interested parties will be given an opportunity to be heard. Any interested party unable to attend the public hearing may submit written comments to the undersigned prior to the public hearing at enotification@bwc.state.oh.us.
