    3309-1-35 is being amended to change the waiver provision in order to comply with Medicare rules, to provide new bases for health care coverage to be cancelled and reinstated, and to add a new eligibility requirement for a subsidy.

    7.  If the rule is an AMENDMENT, then summarize the changes and the content of the proposed rule; If the rule type is RESCISSION, NEW or NO CHANGE, then summarize the content of the rule:

    Amendments to provide that health care coverage for benefit recipients whose

    benefits are suspended for failing to submit required documentation shall be cancelled when benefits are suspended and reinstated when benefits are reinstated.

    Amendments to reflect that Medicare eligible spouses and dependents must waive their health care coverage, the retiree cannot waive their coverage on their behalf.

    Amendments add requirement that, for benefit effective dates on or after August 1, 2008, a member or retiree must have been eligible for health care when employed in order to be eligible for a premium subsidy.

    Removed amendments that established the 740 hour rule regarding premium subsidies, added requirement that person must have been eligible for health care coverage from employer in order to be eligible for a premium subsidy. Added provisions cancelling coverage when benefits are suspended for documentation failures, and reinstating coverage if benefits are reinstated.
