Application and procedureProcedures for renewal of a child care center licenselicensure.(A) The department shall mail
applicationthe JFS 01210 "Application for Child Care License" (rev. 01/2007) and all other required forms for renewal of a license to the center at least one hundred twenty calendar days prior to thedate ofexpiration date of the license.(B)
Applying for renewal: everyThe person, firm, organization, institution, or agencywishing to renewresponsible for renewal of a license shall, completethe following:and submit the JFS 01210 and all other required forms, and payment of the license renewal fee at least sixty calendar days prior to the expiration date of the current license. The application shall be considered filed with the department as of the date it is postmarked. An application received by means other than the postal service shall be considered filed when it is time/date stamped by the department. Any application submitted without complete and/or accurate information must be amended with complete and/or accurate information.(1)
Apply to the director of the Ohio department of job and family services forrenewal licensure by completing the JFS 01210 "Application for Child CareLicense".(2)
File the application for renewal licensure not less than sixty days prior to theexpiration of the center's current license. The application shall be consideredto be filed with the director as of the date the application is postmarked.Applications received by means other than the postal service shall beconsidered received when time/date stamped in the department's child carelicensing section. Any receipted application submitted without completeand/or accurate information must be amended with complete and/or accurateinformation before renewal licensure.(C)
Penalties for nontimely renewal application: ifWhen the department does not receive the application and feeare not receivedat least sixty days prior to the expiration date of the current licenseexpiration date, thecenterfollowing shall occur:(1)
MustThe center must pay a late fee of one hundredandfifty dollars,for a totalof two hundred dollarsin addition to the fifty dollar license renewal fee, for a total of two hundred dollars,withand the applicationto be filed by certifiedmail no later than the license expiration datemust be filed with the department no later than the expiration date of the current license.Late feesfiled after the license expiration date will increase an additional one hundreddollar fee for a total of three hundred dollars.(2)A renewal application and fee filed with the department after the expiration date of the current license must include a total fee of three hundred dollars, this includes a one hundred dollar fee in addition to the fifty dollar renewal fee
and the one hundred fifty dollar late fee.
(2)(3)Will loseThe center loses all legal rights to continue to do business at the licensed location after the expiration date of the current licensewhenif theapplication and license renewal
feefees are noton filefiled with thedepartment in compliance with the requirements of
paragraph (C)(1) ofthis rule.(D)
Failure to file a renewal application: failureFailure to filea renewalan application for renewal of a license prior to thelicenseexpiration date of the current license renders the current license invalid. The center:(1) Has no rights to an appeal through the administrative hearing process pursuant to section 5104.03 and Chapter 119. of the Revised Code.
(2) Shall be subject, after the license expiration date, to any penalty that could be assessed under
5104.09section 5104.99 of the Revised Code.(E)
Renewal inspection: upon the filing ofUpon receipt of an application for renewal of a license, thedirector's representativedepartment shall inspect the center for compliance with Chapter 5104. of the Revised Code and Chapter 5101:2-12 of the Administrative Code, and provide a written inspection report to the licensee and administratorwithin a reasonable timeafter the inspection. The written inspection report shall include the following:(1) A statement of the
violation(s), if any;noncompliance findings.(2) What action must be
completed to correct the violation(s);taken by the applicant to achieve compliance.(3) The date
by which the correction must be completedthe department must receive verification of compliance.(F)
Renewing the license: when, after investigation and inspection, the director'srepresentative has determinedFollowing the inspection, if the department determines that all requirements are in compliance, thelicensedepartment shallberenewedrenew the license for a period of two years.Effective: 09/01/2007
