    5101:2-12-06               Application and procedure Procedures for renewal of a child care center license licensure .

     

     

     

    (A)    The department shall mail application the JFS 01210 "Application for Child Care License" (rev. 01/2007) and all other required forms for renewal of a license to the center at least one hundred twenty calendar days prior to the date of expiration date of the license.

     

    (B)    Applying for renewal: every The person, firm, organization, institution, or agency wishing to renew responsible for renewal of a license shall, complete the following: and submit the JFS 01210 and all other required forms, and payment of the license renewal fee at least sixty calendar days prior to the expiration date of the current license. The application shall be considered filed with the department as of the date it is postmarked. An application received by means other than the postal service shall be considered filed when it is time/date stamped by the department. Any application submitted without complete and/or accurate information must be amended with complete and/or accurate information.

     

    (1)Apply to the director of the Ohio department of job and family services for renewal licensure by completing the JFS 01210 "Application for Child Care License".

     

    (2)File the application for renewal licensure not less than sixty days prior to the expiration of the center's current license. The application shall be considered to be filed with the director as of the date the application is postmarked. Applications received by means other than the postal service shall be considered received when time/date stamped in the department's child care licensing section. Any receipted application submitted without complete and/or accurate information must be amended with complete and/or accurate information before renewal licensure.

     

    (C)   Penalties for nontimely renewal application: if When the department does not receive the application and fee are not received at least sixty days prior to the expiration date of the current license expiration date, the center following shall occur:

     

    (1)   Must The center must pay a late fee of one hundred and fifty dollars, for a total of two hundred dollars in addition to the fifty dollar license renewal fee, for a total of two hundred dollars, with and the application to be filed by certified mail no later than the license expiration date must be filed with the department no later than the expiration date of the current license. Late fees filed after the license expiration date will increase an additional one hundred dollar fee for a total of three hundred dollars.

     

    (2)A renewal application and fee filed with the department after the expiration date of the current license must include a total fee of three hundred dollars, this includes a one hundred dollar fee in addition to the fifty dollar renewal fee

     

     

    and the one hundred fifty dollar late fee.

    (2)(3) Will lose The center loses all legal rights to continue to do business at the licensed location after the expiration date of the current license when if the

    application  and  license  renewal  fee  fees  are  not

    on  file  filed  with  the

    department in compliance with the requirements of paragraph (C)(1) of this rule.

    (D)   Failure to file a renewal application: failure Failure to file a renewal an application for renewal of a license prior to the license expiration date of the current license renders the current license invalid. The center:

    (1)   Has no rights to an appeal through the administrative hearing process pursuant to section 5104.03 and Chapter 119. of the Revised Code.

    (2)    Shall be subject, after the license expiration date, to any penalty that could be assessed under 5104.09 section 5104.99 of the Revised Code.

    (E)   Renewal inspection: upon the filing of Upon receipt of an application for renewal of a license, the director's representative department shall inspect the center for compliance with Chapter 5104. of the Revised Code and Chapter 5101:2-12 of the Administrative Code, and provide a written inspection report to the licensee and administrator within a reasonable time after the inspection. The written inspection report shall include the following:

    (1)   A statement of the violation(s), if any; noncompliance findings.

    (2)   What action must be completed to correct the violation(s);taken by the applicant to achieve compliance.

    (3)     The date by which the correction must be completed the department must receive verification of compliance.

    (F)      Renewing the license: when, after investigation and inspection, the director's representative has determined Following the inspection, if the department determines that all requirements are in compliance, the license department shall be renewed renew the license for a period of two years.
