***PUBLIC HEARING NOTICE***

 

The Office of the Ohio Public Defender ("OPD")  is a state agency whose rules and regulations are filed as Chapter 120 of the Ohio Administrative Code ("OAC").  Chapter 120 of the OAC contains rules for operation of county public defender offices, non-profit agencies who act as public defenders, and contract attorneys who take public defender appointments. The rules include qualification standards for attorneys who accept appointed cases from courts, reimbursement standards, and procedures for various procedures which arise while practicing public defense.  Further, Chapter 120 includes procedures and rules relating to acquisition and storage of personal information which occurs during the practice of indigent defense.

 

OPD reviewed, added to, and updated these rules and intends to adopt the changes as controlling once they are reviewed by the state's Joint Committee on Agency Rule Review ("JCARR").  The following rules are subject to rescission and replacement or amendment: 120-1-01, 120-1-03, 120-1-04, 120-1-05, 120-1-06, 120-1-07, 120-1-09, 120-1-10, 120-1-11, 120-1-12, 120-1-13,

120-1-15, 120-1-16, 120-1-17, and 120-2-01. The following rules are new rules added to

Chapter 120 of the OAC: 120-3-01, 120-3-02, 120-3-03, 120-3-04, and 120-3-05.

 

A public hearing on the aforementioned rules will be held at the address listed above on July 27, 2015 from 10:00 a.m. to 12:00 p.m. A copy of the rules subject to the hearing is available for public review at OPD starting June 22, 2015 through July 27, 2015.
