    NOTICE OF PUBLIC HEARING

    On July 6, 2016, the Ohio Department of Commerce, Division of Real Estate and Professional Licensing will hold a public hearing regarding 1301:11-1-02, 1301:11-1-08, 1301:11-1-10, 1301:11-3-03,   1301:11-3-04,   1301:11-4-02,   1301:11-7-02    1301:11-7-03   of   the   Ohio

    Administrative Code. The hearing will be held at 9:00 a.m., at 77 South High Street, 22nd Floor, Columbus, Ohio 43215.

     

    PROPOSED RULE CHANGES

     

    1301:11-1-02 - Amendment

     

    Open public meeting - Division staff recommends that this rule be amended.

     

    Paragraph B - The proposed amendment was made to reflect the current email address for the Ohio Division of Real Estate & Professional Licensing.

     

    1301:11-1-08 - Amendment

     

    Licensed or certified appraisers from other states - Division staff recommends that this rule be amended.

     

    The purpose of this rule is to establish the procedure for an out of state licensed or certified appraiser to obtain an Ohio residential real estate appraiser license or certification. Title XI of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 established the Appraiser Qualifications Board ("AQB"). The AQB establishes the minimum requirements for certified real property appraisers. Pursuant to provisions of the Dodd-Frank Reform Act, the AQB establishes the minimum requirements for "Licensed Appraisers" and "Trainee Appraisers" which would include registered Ohio real estate appraiser assistants. States must follow AQB requirements.

     

    Paragraphs A, B & C - The proposed amendments were made to reflect current AQB requirements and to comply with Ohio Revised Code Section 4763.11(H). The proposed amendments were made to correct grammatical mistakes and clarify existing requirements.

     

    1301:11-1-10 - Amendment

     

    Settlement agreements - Division staff recommends that this rule be amended. Paragraph B - The proposed amendments were made to correct grammatical mistakes. Paragraph E - The proposed amendment was made to clarify existing requirements.  1301:11-3-03 - Amendment

    Education  requirements  for  applicants  for  licensing  and  certification  -  Division  staff recommends that this rule be amended.

     

    Paragraphs A & K - The proposed amendments are consistent with AQB requirements.

     

    Paragraph J - The proposed amendment clarifies existing requirements.

     

     

     

     

     

    1301:11-3-04 - Amendment

    Experience requirement - Division staff recommends that this rule be amended. Paragraph G - The proposed amendment is consistent with AQB requirements. Paragraph O - The proposed amendment clarifies existing requirements.

    1301:11-4-02 - Amendment

    Education requirements for registration as a state-registered real estate appraiser assistant

    - Division staff recommends that this rule be amended.

    Paragraph H - The proposed amendment clarifies existing requirements.

    1301:11-7-02 - Amendment

    Continuing education course approvals - Division staff recommends that this rule be amended.

    Paragraphs A, B, E & H - The proposed amendments were made to correct grammatical mistakes.

    Paragraph A - The proposed amendment clarifies the process.

    Paragraphs B & H - The proposed amendment clarifies previously existing requirements.

    Paragraph G - The proposed amendment is consistent with AQB requirements.

    1301:11-7-03 - Amendment

    Distance Education - Division staff recommends that this rule be amended.

    Paragraph G - The proposed amendments were made to correct grammatical mistakes.

    At the public hearing, any person affected by the proposed actions may appear and be heard in person, by the person's attorney, or both, may present the person's position, arguments, or contentions, orally or in writing, offer and examine witnesses, and present evidence tending to show that the proposed rule or amendments, if adopted or effectuated, will be unreasonable or unlawful.

    Any person who wishes to present his or her position, arguments or contentions in writing may do so by mailing his or her written comments to the Ohio Department of Commerce, Division of Real Estate & Professional Licensing, 77 S. High Street, 20th Floor, Columbus, OH 43215. Written comments may also be submitted at the hearing. All written comments must be submitted to the Department no later than 5:00 pm. on July 5, 2016.  Written comments submitted after this
