    Rescinding this rule is part of a larger nutrition rule project. For more information, please review the business impact analysis (BIA).

    The rule regulates ODA-certified providers when they provide home-delivered meals to individuals enrolled in the PASSPORT Program. Please review the BIA and its appendices for detailed information on amendments.

    121.71 to 121.74 of the Revised Code because the text or other material is generally available to persons who reasonably can be expected to be affected by the rule, provide an explanation of how the text or other material is generally available to those persons:

    The rule references federal standards available online for the general public free of charge.

    The rule references 2 federal standards: dietary reference intakes (DRIs) and the Dietary Guidelines for Americans. ODA did not upload the standards because, as the rule text itself states, the federal government makes the DRIs available to the general public free of charge on http://fnic.nal.usda.gov/ and the dietary guidelines available to the general public free of charge on http://www.health.gov/dietaryguidelines.

    10.  If the rule is being rescinded and incorporates a text or other material by reference, and it was infeasible for the agency to file the text or other material, provide an explanation of why filing the text or other material was infeasible:

    The rule references federal guidelines which are available online for the general public free of charge.

    On April 18, 2016, ODA made a revised filing of the rule to correct the RSFA so that it mentioned the Dietary Guidelines for Americans, but didn't refer to a particular edition, because the rule doesn't refer to a particular edition.

    There is no cost of compliance directly associated with rescinding the rule because ODA would be simultaneously adopting a new rule in its place. For information on the cost of complying with the new rule, please review the BIA and its appendices.
