3701-83-48 Equipment standards.

 

 

 

NOTICE OF PUBLIC HEARING

 

 

 

The Director of the Ohio Department of Health has proposed to amend existing rules 3701-83-46, 3701-83-48 and 3701-83-53 and to rescind existing rules 3701-84-44 and 3701-84-45 of the Ohio Administrative Code (O.A.C.).

 

O.A.C. 3701-83-46, 3701-83-48 and 3701-83-53 pertain to licensure of two types of Health Care Facilities: Freestanding Diagnostic Imaging Centers and Freestanding Radiation Therapy Centers. This action is being taken under the authority of section 3702.12 of the Ohio Revised Code (O.R.C.). The amendments are being proposed to provide clarification in some sections of the rules.

 

O.A.C. 3701-84-44 and 3701-84-45 pertain to Obstetric and Newborn Health Care Services. This action is being taken under the authority of O.R.C. 3702.11. The rules are being proposed for rescission because they are substantially the same as O.A.C. 3701-7-04 and 3701-7-05, respectively, making them redundant.

 

In accordance with Chapter 119 of the Revised Code, the Director, or his designee, will conduct a public hearing on the proposed action on Monday, July 7, 2003 at 2:00 p.m. The hearing will be conducted in the 6th floor conference room, Ohio Department of Health, 246 North High Street, Columbus, Ohio.

 

At the hearing, persons affected by the proposed action may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rule, if adopted or effectuated, will be unreasonable or unlawful.
