    PUBLIC NOTICE

    The Ohio State Racing Commission will hold a public hearing for the purpose of accepting testimony on the proposed amended rule package containing rules found in chapter 3769-14 of the Ohio Administrative Code.

    These rules relate to the role of permit holders and officials in harness racing.  Additionally, these rules were reviewed in accordance with the requirements of Ohio Revised Code 119.03 and have been proposed as follows.

    -          Ohio Administrative Code 3769-14-12, titled Maintain ambulance. This rule is being amended to require certified paramedics to staff the ambulance which is stationed at the race tracks. The purpose of this rule change is to insure adequate medical staffing at the race tracks.

    -          Ohio Administrative Code 3769-14-14, titled Refuse pits. This rule is being amended to allow permit holders to spray refuse pits on a timely, routine schedule, rather than every day. The purpose of this amendment is to allow permit holders flexibility in their maintenance of the race track while still insuring the health and safety of race track participants and the public.

    -          Ohio Administrative Code 3769-14-17, titled Living quarter. This rule is being amended to require separate dormitories and adequate beds for stable employees. The purpose of this amendment is to protect the health and safety of stable employees.

    -          Ohio Administrative Code 3769-14-18, titled Temporary hospital. This rule is being amended to allow paramedics and emergency medical technicians to staff the first aid room at the race tracks.  The rule, if adopted, will be retitled "First aid room." The purpose of the amendment is to reflect the needs of the race track.

    -          Ohio Administrative Code 3769-14-19, titled Visual recording. This rule is being amended to allow permit holders to record rather than video tape each race.  The purpose of this amendment is to reflect technological advances.

    -          Ohio Administrative Code 3769-14-23, titled Provide paddocks and paddock rules. This rule is being amended to allow four, rather than two, owners to enter the paddock on race days. The purpose of the rule is to enable more licensees to enter the paddock.

    -          Ohio Administrative Code 3769-14-41, titled Duties of officials.  This rule is being amended to require presiding judges to consult with permit holders regarding designation of a post time.  The purpose of this amendment is to promote collaboration between commission employees and permit holders.

    -          Ohio Administrative Code 3769-14-44, titled Equipment record.  This rule is being amended to allow freeze brands to be used in identification of a horse. The purpose of this amendment is to reflect the changes in practice at the race track.

    -          Ohio Administrative Code 3769-14-51, titled Charter, identifier. This rule is being amended to allow the clerk of course position to be combined with the charter position. The reason for this change is that technological advances allow these positions to be consolidated into one position.

    The hearing will be conducted in accordance with Chapter 119 of the Ohio Revised Code.  All interested parties are invited to attend the hearing and present oral and/or written testimony.
