    NOTICE OF PUBLIC HEARINGS

     

    In accordance with Chapter 119 of the Revised Code, the Public Health Council (Council) will conduct three public hearings beginning at 10:00 a.m. on August 9, 2007 in the 8th Floor Conference Room of the Ohio Department of Health, 246 N. High Street, Columbus Ohio:

     

    HEARING #1. By authority of R.C. 3748.04, Council proposes to rescind current/file new O.A.C. rule 3701:1-49-20; and to amend rules 3701:1-49-01, 3701:1-49-02, 3701:1-

    49-03, 3701:1-49-04, 3701:1-49-05, 3701:1-49-06, 3701:1-49-07, 3701:1-49-10,

    3701:1-49-11, 3701:1-49-15, 3701:1-49-16, 3701:1-49-17, 3701:1-49-18, 3701:1-49-

    21, and 3701:1-49-26. These rules pertain to Radioactive Materials Standards - Well Logging. They have been reviewed pursuant to R.C. 119.032 (five-year review), and the changes are editorial in nature, made for the purpose of clarity.

     

    HEARING #2. By authority of R.C. 3748.04, Council proposes to rescind current/file new O.A.C. rule 3701:1-52-20; and to amend rules 3701:1-52-02, 3701:1-52-03, 3701:1-

    52-04, 3701:1-52-07, 3701:1-52-09, 3701:1-52-13, 3701:1-52-16, 3701:1-52-17,

    3701:1-52-18, 3701:1-52-22, 3701:1-52-23, and 3701:1-52-27. These rules pertain to

    Radioactive Materials Standards - Irradiators. As with the previous set of rules, these rules have been reviewed pursuant to R.C. 119.032, and the changes are editorial in nature, made for the purpose of clarity.

     

    HEARING #3 By authority of R.C. 3748.04, Council proposes the following actions: 1) to rescind current/file new O.A.C. rules 3701:1-56-01 and 3701:1-56-04; 2) to amend current rules 3701:1-56-02, 3701:1-56-05, 3701:1-56-06, 3701:1-56-09, and 3701:1-

    56-10; and 3) to file new rules 3701:1-56-11, 3701:1-56-12, 3701:1-56-13, 3701:1-

    56-14, 3701:1-56-15, 3701:1-56-16, 3701:1-56-17, 3701:1-56-18, 3701:1-56-19,

    3701:1-56-20, and 3701:1-56-21. These rules pertain to Licenses for Special Nuclear Materials. Amendments to these rules are editorial in nature. New rules 3701:1-57-11 to 3701:1-57-21: 1) require a person/entity to acquire a license prior to receiving or possession of special nuclear material; 2) describe methods for licensees to communicate with the Ohio Department of Health (ODH); 3) describe exemptions to licensure and the process to acquire exemption; 4) explain types of radioactive material licenses that an applicant may obtain from ODH; 5) describe information required on applications; 6) describe requirement for financial assurance if a licensee possesses certain quantities of special nuclear material; and 7) state requirements that must be met before ODH will terminate a license to possess special nuclear material. The Radioactive Materials Committee and Radiation Advisory Council approved the proposed amended and new rules prior to their submission to the Public Health Council.

     

    At the hearings, persons affected by the proposed actions may appear and be heard in person, by an attorney, or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
